`1 WHEREAS, the City Commission of the City of Lubbock has heretofore

E determined and now finds that due to increased vehicular traffic on
r"1 __last 50th Street in the City of Lubbock, it is necessary to open, extend,
I straighten and widen said East 50th Street ; and,
WHEREAS to accomplish this
p purpose, it is necessary to acquire for
( street right of way purposes the feesimple title of the land hereafter

own said land, and the value and total damages to.the owner for the fee simple
title to said land have been appraised in the amount of

Commission finds said amount to be fair and equitable; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
THAT the fee simple title to the following described land situated
in the City of Lubbock, Lubbock County, Texas, be acquired by the City of
Lubbock for the purpose of opening, extending, straightening and widening
the public street known and designated as East 50,th_,Strep t_
which land is more particularly described as follows t,
A parcel of land out of the NE 1/4 of Section 1� Block E, Lubbock County,
Texas, more fully described by metes and bounds as followst
BEGINNING at a point 355.0 feet East and 40.0 feet South of the NW corner
of the NE 1/4 of Section 1, Block E. as said 1/2 section corner was estab-
lished by Sylvan Sanders; (said.point of beginning is 10.0 feet South and
25.0 feet East of the original NW corner of Tract 14 James Subdivision,
an addition to the City of Lubbock)
THENCE South a distance of 4.89 feet to a point;
THENCE Northeasterly a distance of 50.03 feet to a point, said point
being 42.93 feet South of the North line of Section 11 Block E;
THENCE North a distance of 2.93 feet to a point;
.THENCE West a distance of 50.0 feet to the point of beginning.
THAT the owner(s) of said land be offered, through the Right of Way Depart-
ment, the amount appraised as the value and total damages for the fee simple
title and acquisition of said land for the purposes herein stated, for the use
and benefit of the City of Lubbock, and unless accepted forthwith the City
Attorney is hereby authorized and instructed to institute condemnation pro-
ceedings for and on behalf of the City of Lubbock to acquire the fee simple
title to said land as hereinabove described for street purposes.
