WHEREAS, the City Commission of the City of Lubbock has heretofore
determined and now finds that due to increased vehicular traffic on
East 50th Street in the City of Lubbock, it is necessary to open, extend,
straighten and widen said East 50th Street ; and,
WHEREAS, to accomplish this purpose, it is necessary to acquire for
street right of way purposes the fee simple title of the land hereafter
described; and,.
WHEREAS, B. R. Gamblin, 0. B. Stevens, 0. B. Stevens$ Jr.0 and
J. B. Stevens, individually and members of Oil Transport F4uipment Co -

oo€ Taylor County and M. K. Berry, member of Partnership but not individually.
own said land, and the value and total damages to the owner for the fee simple
title to said land have been appraised in the amount of $ 871.00 and the
Commission finds said amount to be fair and equitable; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK:
THAT the fee simple title to the following described land situated
in the City of Lubbock, Lubbock County, Texas, be acquired by the City of
Lubbock for the purpose of opening, extending, straightening and widening
the public street known and designated as East 50th Street
which land is more particularly described as followst
A parcel of land out of the NE 1/4 of Section Z, Block S, Lubbock Cou:ty,
Texas, more fully described by metes and bounds as follows:
BEGINNING at a point 40.0 feet South of the NW corner of the NE 1/4 of
Section 2 Block $;
THENCE South a distance of 12.79 feet to a point;
THENCE Northeasterly a distance of 246.64 feet to a point, said point
being 50.77 feet South and 246.50 feet East of the NW corner of the NE
1/4 of said section;
THZNCE North a distance of 10.77 feet to a point;
THENCE West parallel to and 40.0 feet South of the North line of said.
section a distance of 246.5 feet to the point of beginning.
THAT the owner(s) of said land be offered, through the Right of Way Depart-
ment, the amount appraised as the value and total damages for the feesimple
title and acquisition of said land for the purposes herein stated, for the use
and benefit of the City of Lubbock, and unless accepted forthwith the City
Attorney is hereby authorized and instructed to institute condemnation pro-
ceedings for and on behalf of the City of Lubbock to acquire the fee simple
title to said land as hereinabove described for street purposes.
