RESOLUTION

WHEREAS, the City of Lubbock and the State of Texas, by and through
the State Highway Commission, have entered into a contract as empowered and
�± authorized by Art. 6673-b, Vernon's Annotated Civil Statutes, providing for
1p the location, construction and maintenance of that part of the State Highway
system, which has heretofore been designated as Loop 289 by the State Highway
Commission; and,
WHEREAS, under the terms of the contract the procurement and acqui-
sition of the necessary land needed for road right of way purposes is the ob-
ligation of the City of Lubbock; and,
WHEREAS, the State Highway Commission has deemed it necessary in
order to make certain highway improvements in connection With said "Loop 289"
situated in and adjacent to the City of Lubbock and to the end that this pur-
pose be accomplished, the necessity of which is hereby confirmed by the City
Council of the City of Lubbock, it is necessary that an easement over, across
and thru the land hereinafter described be acquired by the City of Lubbock in
fulfillment and satisfaction of its contractual obligations to the State of
Texas; and,
WHEREAS, H. R. Fluke and wife Olive Fluke and Sterling K. Miller
and wife, Mavis Miller
own or have some character interest inlland needed for the location, construc-
tion and maintenance of said Loop 289, and the value and total damages to the
owners for the casement title to said land have been appraised in the amount
of $575.00 and the Council finds said amount to be fair and equitable; NOW
THEREFORE:
BE= RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT an easement over, across and thru the following described land
situated in Lubbock County, Texas, be acquired by the City of Lubbock for and
on behalf of the State of Texas for the purpose of opening, constructing and
maintaining in conjunction with the State Highway Commission, said "Loop 289"
as a designated part of the State Highway System, which land is more particu-
larly described as follows:
0.231 of one acre of land, being out of and a part of that certain 61.44 acre
tract lying in the Northwest one quarter of Section 4, Block E-2, Lubbock County,
Texas, which 61.44 acre tract being the same tract in unitization agreement
between Fluke and Miller recorded in Volume 939, Page 193, Deed Records of
Lubbock County, Texas, which 0.231 of one acre being more particularly described
by metes and bounds as follows:
BEGINNING at a point in the Northwest right of way line of Loop 289, said
point being opposite Engineers Station 147+93.4, said point being also
1292.8 feet East and 1118.8 feet South of the Northwest corner of said
Section 4;
THENCE North 360 57' West 150.00 feet to a point in the Southeast boundary
line of Tract A — Treasure Island Addition to the City of Lubbock a plat
of said addition being of record in Volume 945, Page 601, Deed Records
of Lubbock County, Texas;

THENCE South 530 03' West 15.0 feet to a corner of said addition;
THENCE West 189.6 feet along the South boundary line of said addition to
a point in the West boundary line of a 30.0 feet drainage easement;
THENCE South 30.0 feet;
THENCE East 193.4 feet along a line parallel to and 30.0 feet South from
the said South boundary line to a point;
THENCE South 360 57' East 123.7 feet to a point in the said North right
of way line of Loop 289;
THENCE North 530 03' East 30.O feet along said North right of way line
to the place of beginning.
THAT the owners of said land be offered, through the Right of Way Depart-
ment, the amount appraised as the value and total damages for the easement
title and acquisition of said land for the purposes herein stated, for the use
and benefit of the City of Lubbock and State of Texas, and unless accepted
forthwith the City Attorney is hereby authorized and instructed to institute
condemnation proceedings to acquire the easement title to said land as herein
above described for highway purposes.
Approved and passed by unanimous vote of the Council this 8th
