RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute
for and on behalf of the City of Lubbock, Change Order No. 1 to that certain Contract No.
15683 by and between the City of Lubbock and Tommy Klein Construction, of Lubbock,
Texas, for McAlister Dog Park per Bid No. 21-15683-JM, and related documents. Said Change
Order No. 1 is attached hereto and incorporated in this resolution as if fully set forth herein and
shall be included in the minutes of the City Council.

"Change Order' means a written order to a Contractor, executed by the Owner, in accordance with the Contract authorizing an addition to, deletion
from, or adjustment or revision of the requirements of the Contract documents, or an adjustment to the compensation payable to the Contractor, or to
the time for perlbrmanee of the Contract and completion of the project, or a combination thereof, which does not alter the nature of project and is an
integral part of the project objective. Adjustments to "Estimated Quantities" to aline time in a Unit Price Contract do not require a Change Order. All
work that alters the nature of the construction or that is not an integral part of the project objective must be let out for public bid.
Description of Change (alteration, deviation, addition, or deletion) caused by conditions encountered during construction not covered by the
The original construction drawings called for the installation of a Sanitary Sewer Line from the new restroom at the McAlister Dog
Park to a tie-in point on 50" Street, west of Frankford Avenue. In an effort to reduce construction costs, initial plans for the
Sanitary Sewer Line called for COL personnel to perform the trenching and installation of required manholes and sewer line. After
project bids were submitted, evaluated, and approved, Staff determined that COL personnel were not available to perform the work
to meet completion at the desired date. Request Change Order #001 for $165,465.60 to cover the cost of installation of a Sanitary
Sewer Line from the new restroom at the McAlister Dog Park as per COL Design Staff.
Where the Change Order is negotiated, the Change Order must be fully documented and itemized as to costs, including material quantities, material
costs, taxes, insurance, employee benefits, other related costs, profit and overhead. Where certain unit prices are contained in the initial Contract, no
deviations are allowed in computing negotiated change order costs.

Ladies and Gentlemen:
The Offeror, in compliance with your Request for Proposals for the McAlister Dog Park having carefully
examined the plans, specifications, instructions to offerors, notice to offerors and all other related contract
documents and the site of the intended work, and being familiar with all of the conditions surrounding the
construction of the intended project including the availability of materials and labor, hereby intends to furnish
all labor, materials, and supplies; and to construct the project in accordance with the plans, specifications and
contract documents, within the time set forth therein and at the price stated below. The price to cover all

Offeror hereby agrees to commence the work on the above project on a date to be specified in a written "Notice
'*"'N Proceed" of the Owner and to substantially complete the project within 180 Consecutive Calendar Days as
stipulated in the specification and other contract documents. Offeror hereby further agrees to pay to Owner as
liquidated damages in the sum of $100 for each consecutivc calendar day after substantial completion set forth
herein above for completion of this project, all as more fully set forth in the General Conditions of the Agreement.
Offeror understands and agrees that this proposal submittal shall be completed and submitted in
accordance with instruction number 29 of the General Instructions to Offerors. Offeror understands that the
Owner reserves the right to reject any or all proposals and to waive any formality in the proposing. The
Offeror agrees that this proposal shall be good for a period of six(60),calendar days after the scheduled
closing time for receiving proposals.
The undersigned Offeror hereby declares that he has visited the site of the work and has carefully
examined the plans, specifications and contract documents pertaining to the work covered by this proposal, and
he further agrees to commence work on the date specified in the written notice to proceed, and to substantially
complete the work on which he has proposed; as provided in the contract documents.
Offerors are required, whether or not a payment or performance bond is required, to submit a cashiees
check or certified check issued by a bank satisfactory to the City of Lubbock, or a proposal bond from a reliable
surety company, payable without recourse to the order of the City of Lubbock in an amount not less than five
percent (5%) of the total amount of the proposal submitted as a guarantee that offeror will enter into a contract,
obtain all required insurance policies, and execute all necessary bonds (if required) within ten (10) days after
notice of award of the contract to him.
