R E S O L U T I O N
WHEREAS, the City Council of the City of Lubbock has heretofore determined
and now finds that due to increased vehicular traffic on Indiana Avenue in the
City of Lubbock, it is necessary to open, extend, straighten and widen said
Indiana Avenue; and,
WHEREAS, to accomplish this purpose, it is necessary to acquire for street
right of way purposes the fee simple title of the land hereafter described; and,
WHEREAS, Lonnie C. Marx and wife, Elizabeth F. Marx and Leo E. Brown and
wife Louvenia Brown own said land, and the value and total damages to the owner
for the fee simple title to said land have been appraised in the amount of
$7,400.00 and the Council finds said amount to be fair and equitable; NOW
THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the fee simple title to the following described land situated in the
City of Lubbock, Lubbock County, Texas, be acquired by the City of Lubbock for
the purpose of opening, extending, straightening and widening the public street
known and designated as Indiana Avenue which land is more particularly described
as follows:
All of Lot 34, Block 1, North Tech Heights Addition to
the City of Lubbock including all improvements.
THAT the owners of said land be offered, through the Right of Way Depart-
ment, the amount appraised as the value and total damages for the fee simple
title and acquisition of said land for the purposes herein stated, for the use
and benefit of the City of Lubbock, and unless accepted forthwith the City
Attorney is hereby authorized and instructed to institute condemnation pro-
ceedings for and on behalf of the City of Lubbock to acquire the fee simple
title to said land as hereinabove described for street purposes.
Approved and passed by unanimous vote of the Council this
