WHEREAS, the City Council of the City of Lubbock finds that public
necessity and convenience requires the enlargement and extension of the Cityts
sanitary sewer system and storm sewer system and further finds that an ease-
ment in, over and under the tracts of land herein described is needed for right
of way to construct sewer lines and appurtenances; and,
WHEREAS, Viola Justus Price, individually and independent executrix
under the will of W. B. Price, deceased, also Anne Price Simmons, indi-
vidually and as trustee of the estate of W. B. Price, deceased and T. B. Simmo
Jr. trustee estate of W. B. Price, deceased, own said land, and damages to be
paid owner or owners for said easement have been appraised in the amount of
$5, 285.00 and the Council finds said amount to be fair and equitable; NOW
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT an easement in, over and under the following
described tract of land situated in Lubbock County, Texas, be acquired by the
City of Lubbock for the purpose of enlarging and extending the Cityts sanitary
sewer system, said tract described as follows:
A strip of land 20. 0 feet in width out of Sections 2, and 3,
Block B, Lubbock County, Texas, and being 10.0 feet on
each side of the following described center line.
COMMENCING at a proposed manhole location in the right
of way of Quirt Avenue said location being 278. 5 feet South
and 52. 3 feet West of the Northwest corner of Section 3,
Block B;
THENCE Northeasterly across the right of way of Quirt
Avenue at 126.8 feet enter the W. B. Price Estate property
at a point on fence line, said point being 263.5 feet Southeast
of a fence corner, said fence corner being the most Westerly
North corner of said W. B. Price Estate property, in all a
distance of 442.30 feet to a point;
THENCE right 120 28t at 947. 1 feet, more or less, leave
the W. B. Price Estate property at a point on fence line,
said point being 88,7 feet North of iron pipe found at fence
corner, in all a distance of 1232. 7 feet to a point;
THENCE right 350 50T at 196.8 feet, more or less, again
enter the W. B. Price Estate property at a point on fence
line, said point being 210.0 feet West of fence corner,
continuing Southeasterly at 446.05 feet leave said W. B.
Price Estate property at a point on fence line, said point
being 319.0 feet North of a fence corner in all a distance
of 721. 30 feet to a point in Lot 163, Puckett Suburban Homes
Addition to the City of Lubbock, Lubbock County, Texas;
THENCE right 520 421 at 172. 70 feet, more or less, again
enter the W. B. Price Estate property at a point on fence
line, said point being 34.0 feet West of the Southeast corner
of said Lot 163, Puckett Suburban Homes Addition, in all a
distance of 828. 60 feet to a point;
THENCE left 200 53t a distance of 614.60 feet to a point, said
point being 103 feet West and 16 feet North of fence corner
post, fence going North and East;
THENCE left 380 54t a distance of 764. 20 feet a point;
THENCE left 70 14t a distance of 1287. 20 feet to a point;
THENCE right 550' 17t a distance of 1240.97 feet to a point;
THENCE left 240 53t at 749.23 feet, more or less, cross
section line entering Section 2, Block B. Lubbock County,
Texas, in all a distance of 923.23 feet to a point in the
Northwest right of way line of the Fort Worth and Denver
Railway Company, said point being 160. 3 feet Northeasterly
from the intersection of said Northwest right of way line
with the West line of said Section 2, Block B.
Be it further_, resolved that a temporary working easement 60 feet wide,
30 feet on each side of the center line of the above described 20 foot sanitary
sewer easement be acquired by the City of Lubbock for the purpose of the
construction and enlargement of the Cityts sanitary sewer system, and that
such temporary easement shall automatically in all respects expire and revert
to the above said owners six (6) months after the completion and installation
of the permanent sanitary sewer system.
SECTION 2. THAT an easement in, over and under the following
described tract of land situated in Lubbock County, Texas, be acquired by the
City of Lubbock for the purpose of enlarging and extending the Cityts storm
sewer system, said tract described as follows:
A strip of land 20.0 feet in width out of Section 3, Block B,
Lubbock County, Texas, being 10.0 feet on each side of the
following described center line:

_BEGINNING at a point in the North line of the W. B. Price
Estate property, said point being 24.0 feet East of the South-
east corner of Lot 163, Puckett Suburban Homes Addition_
to the City of Lubbock, Lubbock County, Texas;
THENCE South 620 03t West a distance of 550.0 feet,more
or less, to a point on the creek channel.
Be it further resolved that a temporary working easement 60 feet wide,
30 feet on each side of the center line of the above described 20 foot storm sewer
easement be acquired by the City of Lubbock for the purpose of the construction
and enlargement of the Cityts storm sewer system, and that such temporary
easement shall automatically in all respects expire and revert to the above
said owners six (6) months after the completion and installation of the permanent
storm sewer system.
THAT the owners be offered, through the Right of Way Department, the -
amount appraised as total damages for said easement, and unless accepted forth-
with that condemnation proceedings be timely instituted by the 'City Attorney to
acquire said easement in, over and under said tract of land for 19
the purpose of
constructing and maintaining sewer lines and appurtenances therein, together
with full rights of ingress, egress and regress for such purposes.
Approved and passed by unanimous vote of the Council this 23rd day
of April , 1964.
