HomeMy WebLinkAboutResolution - 051266C - Land Acquisition - J.M Ayers - Nelson-Brown Addition - 05/12/1966R E S O L U T I O N WHEREAS, the City Council of the City of Lubbock has heretofore determined and now finds that due to increased vehicular traffic on Quirt Avenue in the City of Lu bock, it is necessary to open, extend, straighten and widen said Quirt Avenue; and, WHEREAS, to accomplish this purpose, it is necessary to acquire for street righ of way purposes the fee simple title of the land hereafter described; and, WHEREAS, J. M. Ayers and wife, Bivian.Ayers own said land, and the value and total damages to the owner for the fee simple title to said land have been appraised in the amount of $700.00 and the Council finds said amount to be fair and equitable; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the fee simple title to the following described land situated in the City of Lubbock, Lubbock County, Texas, be acquired by the City of Lubbock for the purpos of opening, extending, straightening and widening the public street known and des- ignated as Quirt Avenue which land is more particularly described as follows: A parcel of land out of the South 1/2 of Lot 1, Block 11, Nelson -Brown Addi- tion to the City•of Lubbock, Lubbock County, Texas, more fully described as follows: BEGINNING at a point in the South line of said Lot 1, Block 11, Nelson -Brown Addition, said point being 13.0 feet West of the Southeast corner of said Lot 1; THENCE North, parallel to and 13.0 feet West of the East line of said Lot 1, a distance of 152.5 feet to a point; THENCE West a distance of 17.0 feet to a point; THENCE South a distance of 137.5 feet to a point, said point being the be- ginning of a curve to the right; THENCE along said curve to the right, said curve having a radius of 15.0 feet and a tangent of 15.0 feet, a distance of 23.56 feet to the end of said curve, said point being in the South line of said Lot 1, Block 11; THENCE East a distance of 32.0 feet to the POINT OF BEGINNING. THAT the owners of said land be offered, through the Right of Way Department, the amount appraised as the value and total damages for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock, and unless accepted forthwith the City Attorney is hereby autb ized and instructed to institute condemnation proceedings for and on behalf of the ,ity of Lubbock to acquire the feesimple title to said land as hereinabove describ for street purposes. d and passed by unanimous vote of the Council this 12thday of 1966.
