WHEREAS„ the minutes of the City Council meeting of April 28,
1966, contains as error as to the disposition of item eight thereon;
and, whereas it is the desire of the City Council that the minutes
reflect the true actions of the Council with regard to this matter; NOW
THEREFORE.,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the official minutes of the City Council
be amended to show that ordinance 4919, item 8 on the City Council
meeting of April 28,'1966 was not passed on second reading.
SECTION 2. THAT the City Secretary is hereby instructed
to make a marginal notation in the minute s of April 28, 19 6 6 re
fleeting the action herein taken correcting said minutes.

I believe you show in the minutes for the above item that Ordinance No. 4919
was passed on second and final reading. I have listened to the tape recording of
this part of that meeting and I find that Mr. Kastman made the motion that "for
and in consideration of the sum $5,000.00, the ordinance be passed on second read-
ing and the quit claim deed issued".
Mr. Osborne has not paid the $5,000.00 and indications are that he does not
intend to. Your minutes should reflect that this was a conditional passage and
the ordinance is not to be considered as passed unless and until the $51,000.00
consideration is received. I ate holding the quit claim deed in my files. It has
been signed by the Mayor.
You might wish to talk to Fred Senter about the possibility that this needs
to go back to the Council to have a time limit put on it. Unless this is done it
would appear that they could come back several years from now and expect to pay
the $5,000.00 and close the matter. This could be a bad situation if the street
had been paved, additional utilities constructed in same or land values in the
area being considerably higher at the later date.
