.�. WHEREAS, the City Council of the City of Lubbock has heretofire determined and
now finds that due to increased vehicular traffic on College Avenue in the City of
Lubbock, it is necessary to open, extend straighten and widen said College Avenue;
and,

WHEREAS, to accomplish this purpose, it is necessary to acquire for street rigtt
f way purposes the fee simple title of the land hereafter described;and,
WHEREAS, David W. Martin and J. A. Hodges own said land, and the value and tota
amages to the owner for the fee simple title to said land have been appraised in th
mount of $19,700.00 aid the Council finds said amount to be fair and equitable; NOW
HEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the fee simple title to the following described land situated in the City
of Lubbock, Lubbock County, Texas, be acquired by the City of Lubbock for the purpo
of opening, extending, straightening and widening the public street known and des-
ignated College Avenue which land is more particularly described as follows:
Lot 1 and the East 28.0 feet of Lot 2, Block 6, Ellwood Place,
an Addition to the City of Lubbock, Lubbock County, Texas;
Save and Except that part of said Lot l previously conveyed
to the City of Lubbock by deed dated February 24, 1960, said
deed being recorded in Volume 783, Page 95, Lubbock County
Deed Records.
THAT the owners of said land be offered, through the Right of Way Department,
he amount appraised as the value and total damages for the fee simple title and
cquisition of said land for the purposes herein stated, for the use and benefit of
he City of Lubbock, and unless accepted forthwith the City Attorney is hereby auth
zed and instructed to institute condemnation proceedings for and on behalf of the
ity of Lubbock to acquire the fee simple title to said land as hereinabove describ
or street purposes.
