HomeMy WebLinkAboutResolution - 111067C - Canvassing And Declaring Result Of Bond Election - 11/10/1967�i RESOLUTION AND ORDER CANVASSING RETURNS AND DECLARING RESULT OF BOND ELECTION THE STATE OF TEXAS CITY OF LUBBOCK COUNTY OF LUBBOCK ON THIS the 10th day of November 1967, the City Council of the City of Lubbock, Texas, convened in Special session, being open to the public, at the regular meeting place thereof in the City Hall, there being present and in attendance the following members: W. D. ROGERS, JR. MAYOR JAMES H. GRANBERRY, D.D.S. ) JACK KASTMAN ) RAY J. DIEKEMPER, JR. ) COUNCILMEN W. E. MEDLACK ) and W. R. BLACKWELL CITY MANAGER and (MRS.) LAVENIA LOWE CITY SECRETARY also being present; and with the following absent: None constituting a quorum; at which time.the following, among other business was transacted: Councilman Medlock introduced the following resolution and order: WHEREAS, there was held in the City of Lubbock, Texas, on the 9th day of November, 1967, an election at which there were submitted to the duly qualified resident taxpaying electors of said City, propositions in the following amounts and for the following purposes: $1,285,000 general obligation bonds of said City for the purpose of making permanent public improvements_, to -wit:. constructing improve- ments and extentions to the City's Waterworks System; $2$95,000 general obligation bonds of said City for the purpose of making permanent public. improvements, to -wit: constructing improve- ments and extensions to the City's Sanitary Sewer System; -A $6,807,000 general obligation bonds of said City for the purpose of constructing street improvements in and for said City, in- cluding the acquisition of necessary right- of-way for expressways and other streets; $30000,000 general obligation bonds of said City for the purpose of making permanent public improvements to -wit: constructing and equipping a Civic Center and the acquisition of a site therefor; $1,610,000 general obligation bonds of said City.for the purpose of making permanent public improvements, to -wit: acquiring or improving, either or both, land for park purposes; $9,500,000 revenue bands of said City for the purpose of making permanent public improvements, to -wit: extending and improving the City's Electric Light.System; .$800,000 general obligation bonds of said City for the purpose of making permanent public improvements, to -wit: the acquisition, construction and equipping of a library building in and for said city and the acquisition of a site therefor; $1,370,000 general obligation bonds of said City for a public purpose, to -wit: the construction and equipment of a sanitation -garbage -trash disposal facility, a public utility for said City, including the acquisition of land therefor; i $215,000 general obligation bonds of said City for the purpose of making permanent public improve- ments, to -wit: constructing, improving and equipping fire station buildings and the L purchase of necessary sites therefor in. and for said City; $350,000 general obligation bonds of said City for the purpose of making permanent public improvements, to -wit: constructing and equipping a maintenance garage for City vehicles and the acquisition of a site therefor; $19950,000 general obligation bonds of said City for the purpose of making permanent public improvements, to -wit: construcing, enlarging, and extending and installing storm sewers, drains, and gutters and other improvements incidential thereto, including the acquisition of land for drainage purposes and drainage area modifications for mosquito control; AND WHEREAS, upon consideration of the returns of said election, it appears that the same was in all respects legally held, after due notice had been given, and that the said returns were duly and legally made; and, WHEREAS, it appears from said returns that with respect to Proposition Number 1, "THE ISSUANCE OF $1,285,000 WATERWORKS BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF", 6,261 votes were cast "FOR" the proposition and — 5.482 votes were cast "AGAINST" the proposition; and, WHEREAS, it further appears from said returns that with respect to Proposition Number 2, "THE ISSUANCE OF $2,395,000 SEWER SYSTEM BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF" _ 6,483 votes were cast "FOR" the proposition and 5,233 votes were cast "AGAINST" the proposition; and, WHEREAS, it further appears from said returns that with respect to Proposition Number 3, "THE ISSUANCE OF $6,807,000 STREET IMPROVEMENT RIGHT-OF-WAY (FOR EXPRESSWAYS AND OTHER STREETS) BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF", 6.460 votes were cast "FOR" the proposition and 5,274 votes were cast "AGAINST" the proposition; and, WHEREAS, it further appears from said returns that with respect to Proposition Number 4, "THE ISSUANCE OF $3,0002000 CIVIC CENTER BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF" 4,345 votes were cast "FOR" the proposition and 7,363 votes were cast "AGAINST" the proposition; and, WHEREAS, it further appears from said returns that with respect to Proposition Number 5, "THE ISSUANCE OF $1,610,000 PARK BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF", 5,067 votes were cast "FOR" the proposition and 6,632 votes were cast "AGAINST" the proposition; and WHEREAS, it further appears from said returns that with respect to Proposition Number 6, "THE ISSUANCE OF $9,500,000 REVENUE BONDS FOR ELECTRIC LIGHT SYSTEM IMPROVEMENTS AND EXTENSIONS AND PLEDGING THE REVENUES OF SAID SYSTEM TO THE PAYMENT THEREOF" 4,640 votes were cast "FOR" the proposition and 7,078 votes were cast "AGAINST" the proposition; and WHEREAS, it further appears from said returns that with i respect to Proposition Number 7, "THE ISSUANCE OF $800,000 LIBRARY BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF", 5,676 votes were cast "FOR" the proposition and 6,028 votes were cast "AGAINST" the proposition; and WHEREAS, it further appears from said returns that with respect to Proposition Number 8, "THE ISSUANCE OF $12370,000 SANITATION -GARBAGE -TRASH DISPOSAL FACILITY BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF", 61743 votes were cast "FOR" the proposition and 41,982 votes were cast "AGAINST" the proposition; and WHEREAS, it further appears from said returns that with respect to Proposition Number 92 "THE ISSUANCE OF $215,000 FIRE STATION BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF", 6,702 votes were cast "FOR" the proposition and 5,001 Votes were cast "AGAINST" the proposition; and ' WHEREAS, it further appears from said returns that with respect to Proposition Number 10, "THE ISSUANCE OF $350,000 MAINTENANCE GARAGE BONDS AND THE LEVY OF A TAX IN PAYMENT THEREOF", 5.516 votes t were cast "FOR" the proposition and 6.171 votes were cast "AGAINST" the proposition; and, WHEREAS, it further appears from said returns that with respect to Proposition Number 11, "THE ISSUANCE OF $1,950,000 DRAINAGE IMPROVEMENT BONDS (INCLUDING ACQUISITION OF LAND AND DRAINAGE AREA MODIFICATIONS FOR MOSQUITO CONTROL) AND THE LEVY OF A TAX IN PAYMENT THEREOF", __ 6,646 votes were cast "FOR" and 5,062 votes were cast "AGAINST" the proposition, therefore, BE IT RESOLVED .AND ORDERED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: SECTION 1: That the aforesaid election was duly and legally . called and notice thereof given in accordance with the laws of the State of Texas and the ordinance ordering said election; that said election was held in strict conformity with the Cons- titution and laws of the.State of Texas, and the returns thereof have been properly made to the officials of the City entitled to receive same; that only resident qualified property taxpaying electors, who owned taxable property in said City, and who had duly rendered the same for taxation, were permitted to vote at said election, and further that said election properly represents the desires of those qualified to vote as aforesaid. SECTION 2: That the proposition to issue $1,285,000 general j obligation bonds of said City for the purpose of constructing improvements and extensions to the City's Waterworks System, was sustained by a majority of the resident qualified electors of said City, voting at said election, who owned taxable property in said City, and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the -principal -of and interest on said bonds,in the time and manner prescribed by law. SECTION 3: That the proposition to issue $2,395,000 general obligation bonds of said City for the purpose of constructing improvements and extensions to the City's Sanitary Sewer System, was sustained by a majority of the resident qualified electors of said City, voting at said election, who owned taxable property in said City and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the principal of and interest on said bonds in the -time and manner pre- scribed by law. l SECTION 4: That the proposition to issue $6,807,000 general obligation bonds of said City for the purpose of constructing street improvements in and for said City, including the acquisition of necessary right-of-way, for expressways and other streets, was sustained by a majority of the resident qualified electors of said City, voting at said election, who owned taxable property in said City and who had duly rendered the same for taxation, and that the City Council of said City f is authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the principal'of and interest on said bonds in the time and manner prescribed by law. SECTION 5:' That the proposition to issue $3,000,000 general obligation bonds of said City for the purpose of making permanent public improvements, to -wit: constructing and equipping a Civic Center and the acquisition of a site therefor, was &T' sustained by.a majority of the resident qualified electors of said City, voting at said election, who owned taxable property in said City and who had duly rendered the same for taxation, and that the City Council of said City is A&r authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the principal of and interest on said bonds in the time and manner prescribed bylaw. SECTION 6: That the proposition to issue $1,610,000 general obligation bonds of said City for the purpose of acquiring Ior improving, either or both, land for park purposes, was sustained Iby a majority of the resident qualified electors of said City, voting at said election, who owned taxable property in said City and who had duly renderferdthe same for taxation, and that the City Council of said City is�4authorized to issue said bonds and to levy - and have assessed and collected taxes for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 7: That the proposition to issue $9,500,000 revenue bonds of said City for the purposg rof extending and improving the City's electric light system, was4sustained by a majority of the president qualified electors of said City, voting at said election who owned taxable property in said City and who had duly rendered the same for taxation, and that the City Council of said City is Nd"r authorized to issue said bonds and to provide for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. 'SECTION 8; That the proposition to issue $800,000 general obligation bonds of said city for the purpose of the acquisition, construction and equipping of a library buildi% in and for said City and the acquisition of a site therefor, wasAsustained by a majority of the resident qualified electors of said City, voting at said election who owned taxable property in said City and who had duly rendered tTsame for taxation, and that the City Council of said City i 4 authorized to issue said bonds and Ito levy and have assessed and collected taxes for the payment of the principal of and interest .on said bonds in the time and manner (prescribed by. law. i f SECTION 9: That the proposition to issue $123702000 general obligation bonds of said City for the purpose of the ` construc.tion and equipment of a sanitation -garbage -trash (disposal facility, a public utility for said City, including the acquisition of land therefor, was sustained by a majority of the resident qualified electors of said City, voting at said election who owned taxable property in said City and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the prin- , cipal of and interest on said bonds in the time aad in the manner prescribed by law. SECTION 10: That the proposition to issue $215,000 general obligation bonds of said City for the purpose of constructing, improving and equipping fire station buildings and the purchase of necessary sites therefor in said city, was sustained by a majority of the resident qualified electors of said City, voting at said election who owned taxable property in said City and who had duly rendered the same for taxation, and that the City Council of said City is authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the principal of and interest on said bonds in the time and in the manner prescribed by law. SECTION 11: That the proposition to issue $350,000 general obligation bonds of said City for the purpose of constructing and equipping a maintenance garage for City vehicles and the acquisition of a site therefor, was sustained by a majority of the resident qualified electors of said City, voting at said election, who owned taxable property in said City and who had duly rendered the same for taxation, and that the City Council of said City is NOF. authorized to issue said bonds and to levy and have assessed and collected taxes for the payment of the principal of and interest on said bonds in the time and manner prescribed by law. SECTION 12: That the proposition to issue $1,950,000 general ob igadion bonds of said City for the purpose of construct, ing, enlarging,extending and installing storm sewers, drains and gutters,and other improvements incidental thereto, including acquisition of land for drainage purposes and drainage,area modifications for mosquito control, was sustained by a majority of the resident qualified electors of said City voting at said election, who owned taxable property in said City and who had duly rendered the same for taxation, and that the City Council- of-said-City ouncilofsaid-City is authorized to issue said bonds and to levyand have assessed and collected taxes for the payment of the prin- cipal of and interest on said bonds in the time and manner pre- scribed by law. i The above resolution and order having been read in full, it was moved by Councilman Medlock that.any rule prohibiting the passage of resolutions and orders on the day on which introduced, unless declared as an emergency measure be suspended for the reasons set forth and defined in the preamble thereto. The motion was seconded by Councilman Diekemper and carrie by the following vote: AYES: Mayor Rogers and Councilmen Granberry,a K stman, Diekemper and Medlock. NOES: None. Councilman Aagwg then moved the resolution and order be finally passed as an emergency measure to take effect im- mediately from and after its 2kssage. The motion was seconded by Councilman M and carried by the following vote: AYES: Mayor Rogers and Councilmen Granberry, Kastman, Diekemper and Medlock. NOES: None. The Mayor then announced the final passage and immediate effect of the ordinance as an emergency measure. MINUTES APPROVED, this the 10th day of November, 1967.
