AN ORDINANCE ABANDONING AND CLOSING A PORTION OF A
TEMPORARY DRAINAGE EASEMENT LOCATED IN SECTION 43, BLOCK AK, o
LUBBOCK COUNTY, TEXAS AS DESCRIBED IN COUNTY CLERK FILE NUMBER r
2019029246 OF THE OFFICIAL PUBLIC RECORDS OF LUBBOCK COUNTY, TEXAS,
WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS
ORDINANCE; DIRECTING 'I'I IE CITY ENGINEER TO MARK THE OFFICIAL MAPS r
OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A
SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION.

WHEREAS, the City Council finds that the easement hereinafter described in the body
of this Ordinance is no longer needed for easement purposes and for public use; and it wouldr
be in the public interest to close, vacate and abandon the same for easement purposes and for
public use; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the easement as hereinafter described shall BE and the same is
hereby closed, vacated and abandoned for easement purposes and for public use, such easement
being more particularly described in the attached Exhibit "A."
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the
official maps of the City of Lubbock to reflect said abandonment and closing, showing the
number of this Ordinance and the date of its final passage.
SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word
of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized
and directed to cause publication of the descriptive caption of this Ordinance as an alternative
method provided by law.
AND IT IS SO ORDERED.

A closure, abandonment and vacation of a portion of that certain Temporary Drainage Easement,
52 feet in width, located in Section 43, Block AK, E.L. & R.R. RR. Co. Survey, Abstract No.
184, Lubbock County, Texas, previously recorded in County Clerk's File Number 2019029246
and being situated within that certain 154.64 acre tract of land conveyed to Bushland Springs,
LLC, described in a Special Warranty Deed recorded in County Clerk's File Number
2016029699 of the Official Public Records of Lubbock County, Texas, said portion of the
easement to be closed and abandoned contains 1.277 acres (55,645 sq. feet) of land being further
described individually by metes and bounds as follows:
BEGINNING at a point in the (proposed) south right-of-way line of 23`d Street and the
(proposed) south plat limits of Bushland Springs, Lots 147 through 251, an addition to the City
of Lubbock, Lubbock County, Texas, for the northwest corner of this easement and having
coordinates of Northing: 7,272,706.25 and Easting: 910,909.11, Texas Coordinate System of
1983 (2011), Texas North Central Zone, whence the northwest comer of said Section 43 bears
N. 88' 07' 12" W. a distance of 461.15 feet and N. Ol ° 52' 48" E. a distance of 1749.34 feet, said
section comer having coordinates of Northing: 7,274,469.35 and Easting: 910,505.66, Texas
Coordinate System of 1983 (2011), Texas North Central Zone;
THENCE S. 880 12' 08" E., along the south right-of-way line of said 23`^ Street and the south
plat limits of said Bushland Springs, Lots 147 through 251, a distance of 52.00 feet to a point of
intersection for the most northerly northeast comer of this easement;
THENCE S. Ol ° 47' 52" W. a distance of 250.00 feet to a point of intersection and a comer of
this easement;
THENCE S. 880 12' 08" E. a distance of 216.59 feet to a point of intersection for the most
easterly northeast comer of this easement;
THENCE S. 010 47' 52" W. a distance of 52.00 feet to a point of intersection and a corner of
this easement;
THENCE N. 88e 12' 08" W. a distance of 216.59 feet to a point of intersection and a comer of
this easement;
THENCE S. 01 ° 47' 52" W. a distance of 551.50 feet to a point of intersection for the southeast
corner of this easement;
THENCE N. 880 12' 08" W. a distance of 52.00 feet to a point of intersection for the southwest
comer of this easement;
THENCE N. 010 47' 52" E. a distance of 853.50 feet to the POINT OF BEGINNING. Bearings
