HomeMy WebLinkAboutOrdinance - 2021-O0019 - Abandoning and Closing a portion of a Sewer Line Easement, Reese ParkCT+J.( .*Mk OW CouirKr �+ � First Reading February 23, 2021 Item No. 7.4 ORDINANCE NO. 2021-00019 Second Reading March 9, 2021 Item No. 7.3 SEWER LINE EASEMENT LOCATED IN TRACT D, REESE PARK ADDITION, LUBBOCK COUNTY, TEXAS AS RECORDED IN VOLUME 6731, PAGE 63 OF THE REAL PROPERTY RECORDS OF LUBBOCK COUNTY, TEXAS, WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the easement hereinafter described in the body of this Ordinance is no longer needed for easement purposes and for public use; and it would be in the public interest to close, vacate and abandon the same for easement purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement as hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use, such easement being more particularly described in the attached Exhibit "A." SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. Reese Park Addition 5.21 Parkhill PROPOSED CLOSURE OF A 30-FOOT WIDE SANITARY SEWER EASEMENT IN TRACT "D", REESE PARK, AN ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS A proposed closure of a portion of a 30-foot wide sanitary sewer easement in Tract "D", Reese Park, an addition to the City of Lubbock, Lubbock County, Texas, according to the map, plat and/or dedication deed thereof recorded in Plat and Dedication Number 2020057494 of the Official Public Records of Lubbock County, Texas, being situated in Section 4, Block D-6, Lubbock County, Texas, said proposed closure contains 0.113 acres (4,922 square feet) being further described by metes and bounds as follows: BEGINNING at a 1/2-inch iron rod with a plastic cap marked "H.R. and ASSOC." found at the most northerly northeast corner of said 30-foot wide sanitary sewer easement, originally described in Volume 6731, Page 63 of the Real Property Records of Lubbock County, Texas, for the northeast corner of this proposed closure, said point having coordinates of NORTHING: 7,276,995.59 and EASTING: 893,795.15, Texas Coordinate System, North Central Zone 4202, North American Datum of 1983, whence a 1/2-inch iron rod with a plastic cap marked "H.R. & ASSOC." found at the northeast corner of said Tract "D" bears North 64 degrees 11 minutes 55 seconds East a distance of 160.90 feet and the southeast corner of said Section 4, Block D-6 bears South 88 degrees 15 minutes 27 seconds East a distance of 942.75 feet and South 01 degrees 44 minutes 33 seconds West a distance of 1998.63 feet; (1) THENCE South 47 degrees 41 minutes 32 seconds East, along the north line of said 30-foot wide sanitary sewer easement, a distance of 151.35 feet to a 1/2-inch iron rod with a plastic cap marked `PSC RPLS 6453" set for the most southerly southwest corner of a proposed 15-foot wide sanitary sewer easement surveyed the same date herewith, for the southeast corner of this proposed closure; (2) THENCE South 01 degrees 58 minutes 31 seconds West a distance of 39.35 feet to a 1/2-inch iron rod with a plastic cap marked 'PSC RPLS 6453" set in the south line of said 30-foot sanitary sewer easement, for the southwest corner of this proposed closure, said point having coordinates of NORTHING: 7,276,854.42 and EASTING: 893,905.70, Texas Coordinate System, North Central Zone 4202, North American Datum of 1983, whence a 1/2-inch iron rod with a plastic cap marked "H.R. & ASSOC." found at the southeast corner of said Tract "D" bears South 04 degrees 11 minutes 54 seconds East a distance of 269.12 feet; (3) THENCE North 47 degrees 41 minutes 32 seconds West a distance of 176.82 feet to an 80D nail found at the northwest corner of said 30-foot wide sanitary sewer easement and the northwest corner of said proposed closure; (4) THENCE North 42 degrees 18 minutes 28 seconds East a distance of 30.00 feet to the POINT OF BEGINNING.
