Said Amendment is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. THIS IS THE SECOND AMENDMENT TO THE AGREEMENT dated and entered into on the 23' day of August 2018, Contract No. 14034, by and between the City of Lubbock ("City") and Kimley-Horn and Associates, Inc. ("Engineer"). Engineer is providing professional construction phase services for the design of Upland Avenue Paving Improvements between 66`h Street and 114`h Street. The City and Engineer now desire to enlarge the scope of services in this Agreement to provide for an archeological survey in compliance with the Texas Natural Resources Code, Chapter 191, the Antiquities Code of Texas (ACT). The scope of services for the additional survey are as set forth in Exhibit "A" and incorporated herein. The cost of said services shall not exceed fifteen thousand two hundred dollars and NO/100 ($15,200.00). The contract shall be extended for, and Engineer shall complete the services in Exhibit "A" within, sixty (60) days. All other portions of the original Agreement and previous Amendments, if any, shall remain in place and are not altered by this amendment. Keenum, P.E., Division Director of Engineering/City Engineer Josh Kriktinek, P City Engineer/Capital Projects and Design APPROVED AS TO FORM: Q Kelli Leisure, Assistant City Attorney Page 2 of 2 EXHIBIT A SERVICES TO BE PROVIDED BY SUBCONSULTANT FOR 661h DRAINAGE IMPROVEMENTS From Playa Lake 100 to Playa Lake 039A For CITY OF LUBBOCK (CITY) Project Description This proposal is to conduct an archeological resource survey in advance of the City of Lubbock's channel and drainage improvements along US 62/82 and 661h Street in Lubbock, Texas. The proposed project is intended to drain overflow surface water from roadways and surrounding neighborhoods. Construction will entail excavation and expansion within two natural playa lakes, connected by a lined drainage channel running for a distance of approximately 6,500 feet along US 62/82. A new approximately 19- acre detention basin will be constructed around the playa lake located at 661h Street. The total Area of Potential Effect (APE) comprises 29.6 acres. However, at least 9 acres of the APE will occur along previously disturbed lots and along US 62/82. The project is being sponsored by the City of Lubbock and will take place on city -owned easements. Therefore, it is subject to the Antiquities Code of Texas (ACT). Scope of Services Prior to survey, Subconsultant will coordinate with the Texas Historical Commission to develop a scope and permit application for the field survey. The work plan will include the results of desktop research that may be relevant to assessing previous landscape modifications, and potential for significant archeological resources in the project area. Once the THC issues a permit, Subconsultant will conduct an archeological field survey for all portions within the project area with potential to contain intact archeological resources. Soil and geologic maps suggest that the project area generally has low potential for deeply buried intact archeological deposits. Therefore, the survey will involve visual inspection and shovel testing but no backhoe trenching. Shovel testing will conform to the minimum standards outlined by the Council of Texas Archeologists' (CTA) and will involve two shovel tests per acre within the project area. Although the APE is 29.6 acres, it is estimated that shovel testing is warranted on only 20 acres of the APE, at the location of the two natural playa lakes. Subconsultant anticipates excavating up to 40 shovel tests in support of the project. Previously disturbed areas will be photographed, and investigators will make notes about them. Additional shovel tests would be excavated to further characterize and delineate sites within project area should any be encountered. Shovel test locations will be recorded with a hand-held GPS, all soil from tests will be screened for artifacts, and all tests will be backfilled upon completion. Archeologists will photograph conditions, make notes, and photograph any artifacts within the shovel tests. No artifacts will be collected. Archeological sites will be defined at the Pi's discretion, and site recording will involve up to six additional shovel tests to assess them for eligibility as State Antiquities Landmarks (SAL). For a project in this location and of this size, Subconsultant estimates recording not more than two archeological sites. Following field survey, site forms, if any, will be submitted to TARL for trinomials. Artifacts found in the field will not be collected, but will be photographed and inventoried, then returned to their original location. Subconsultant will prepare a draft archeological survey report that will summarize cultural background data, previous investigations, current investigation findings, and regulatory recommendations. This report will be submitted electronically for review to the City of Lubbock, revised according to that review. Following draft final revision, Subconsultant will submit the report to the THC for regulatory review and concurrence with findings. Once a final draft has been approved, Subconsultant will prepare and submit final reports, notes, and photographs for curation at a federally recognized facility. • Subconsultant estimates survey of the APE will require up to 40 shovel tests. • Formal SAL -eligibility testing or mitigation is not included in this scope of work. • Rights of Entry to private properties will be obtained by others prior to commencement of the survey. • This project would not involve any federal permits, easements, or notifications that would trigger Section 106 consultation and review. Schedule Subconsultant can begin working on developing the permit within five days of receiving written notice - to -proceed (NTP), along with shape files or projects plans depicting limits of proposed ROW and anticipates a duration of up to 60 days to complete field work and finalize report.
