HomeMy WebLinkAboutOrdinance - 9750-1994 - Public Hearing For A.M.T Zoning Change - 11/10/1994First Reading Second Reading November 10, 1994 November 17, 1994 Item #20 Item #8 ORDINANCE NO. 9750 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2740; A ZONING CHANGE FROM R-3 TO C-4 ZONING ON THE NORTH 85 FEET OF THE EAST 124 FEET OF THE SOUTH 147.50 FEET OF TRACT 2 AND THE WEST 316 FEET OF TRACT 2, STUBBS SUBDIVISION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. I j WHEREAS, the 1986 Comprehensive Land Use Plan is a guide to help the Lubbock Planning and Zoning Commission and City Council determine the physical development of the community; however, planning is a continuous process and change is inevitable; and WHEREAS, the Lubbock Planning and Zoning Commission and City Council recognize that the zone change on is a minor deviation from the 1986 Comprehensive Land Use Plan and I attempt to protect public and private commitments that have been previously based on the Plan; and WHEREAS, the proposed changes in zoning as hereinafter made have been duly presented to the Planning and Zoning Commission for its recommendation which was received by the City Council and, after due consideration, the City Council found that due to changed conditions, it would be expedient and in the interest of the public health, safety and general welfare to make those proposed changes in zoning; and WHEREAS, all conditions precedent required by law for a valid amendment to the Zoning Ordinance and Map have been fully complied with, including giving notices in compliance with Section 29-29 of the Code of Ordinances, City of Lubbock, Texas, and the notices provided by the Texas Local Government Code §211.007 (Vernon, 1990), and notice was duly published in the Lubbock Avalanche -Journal more than fifteen (15) days prior to the date of the public hearing before the City Council on such proposed amendment, and the public hearing according to said notice, was held in the City Council Chamber of the Municipal Building, Lubbock, Texas, at which time persons appeared in support of the proposal; and after said hearing, it was by the City Council determined that it would be in the public interest, due to changed conditions, that the Zoning Ordinance and the Zoning Map be amended in the manner hereinafter set forth in the body of this Ordinance and this Ordinance having been introduced prior to first reading hereof; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: ZONE CASE NO. 2740 SECTION 1. THAT Ordinance No. 7084 and the Official Zoning Map are amended as follows: A change of zoning under the provisions of Section 29-29 of the Code of Ordinances of the City of Lubbock from R-3 to C-4 zoning district, on the North 85 feet of the East 124 feet of the South 147.50 feet of Tract 2 and the West 316 feet of Tract 2, Stubbs Subdivision, City of Lubbock, Lubbock County, Texas, located between 35th and 36th Streets, West of Avenue P and subject to conditions. SUBJECT TO THE FOLLOWING CONDITIONS: a. That the C-4 uses shall be limited to the following: 1. Any use conditionally or unconditionally permitted in the "C-2A", "C-2", or "C-3" Districts. 2. Ambulance Service. 3. Automobile Body Shops, outside storage limited to customer vehicles only. 4. Automobile Brake Shop. 5. Automobile Glass Shop. 6. Automobile Seat Cover and Upholstery Shop. 7. Automobile Transmission Shop. 8 Automobile and Recreational Vehicles Sales and Service (may include body and paint shop, as accessory use). 9. Barber and Beauty Shop supply dealer. 10. Builders Supply. All materials must be in a building. 11. Cafe Supply Dealer, Fixtures. 12. Canvas Goods Shop, Tents and Awnings (no manufacturing). 13. Dairy Supply Dealer. 14. Electrical Equipment Repairs. 15. Feed Store with no grinding, packaging, or mixing of feed permitted. 16. Frozen Food Lockers. 17. Game room, Pool, Billiard and/or Domino Parlor. 18. Garage, Public, Repair. (outside storage of customer automobile authorized). All work and separate parts shall be inside a building. 19. Garden Center. ZONE CASE NO. 2740 -PAGE 2 - 20. Gasoline Service Station. (business permitted outside of building and outside displays of products permitted within three (3) feet of the building). 21. Greenhouse and Plant Nursery. 22. Janitorial or Cleaning Service. 23. Job Printing and Lithographing. 24. Laboratory, Chemical, General Analysis. 25. Laundry, Commercial. 26. Linen and Towel Supply Service. 27. Lumber Yard, with no mill. All materials must be in a building. 28. Magazine Agency. 29. Monument Sales. (Outside display permitted). 30. Motorcycle Shop, including Sales, Rentals and Service. 31. Muffler Shop. 32. Nonprofit Training Centers with Retail Sales. 33. Pest Control Service. 34. Portable Building Sales (fully constructed). 35. Print Shop. 36. Produce Market. 37. Rental Store. 38. Rental Store, Heavy Equipment and Trailers only. 39. Restaurants. (Business permitted outside of building). 40. Restaurants, with the sale of alcoholic beverages as an incidental use, except that no mixed alcoholic beverage sales shall be made or delivered to occupants in motor vehicles. Store Fixtures Sales (no manufacturing permitted). 44. Swimming Pool, Commercial or Sales. (business permitted outside building). 45. Trailer and Truck Rental Utility. 46. Upholstery Shop -Furniture. 47. Veterinary Hospital (totally within a building). 48. Wholesale House, Sales Office and storage -no cotton storage. SECTION 2. THAT violation of any provisions of this Ordinance shall be deemed a misdemeanor punishable by a fine not to exceed Two Thousand and No/100 Dollars ($2,000.00) as provided in Section 29-31 of the Zoning Ordinance of the City of Lubbock. SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law. AND IT IS SO ORDERED.
