AN ORDINANCE AMENDING ORDINANCE NO. 9744 ENACTED ON
OCTOBER 14, 1994, ORDERING A SPECIAL ELECTION TO BE HELD ON JANUARY
21, 1995, FOR THE PURPOSE OF VOTING FOR OR AGAINST THE ADOPTION OF
THREE -EIGHTHS (3/8) OF ONE PERCENT SALES AND USE TAX WITHIN THE
CITY OF LUBBOCK FOR ECONOMIC DEVELOPMENT WITH REGARD TO
CONDUCTING SUCH ELECTION AS A JOINT ELECTION WITH LUBBOCK
INDEPENDENT SCHOOL DISTRICT AND WITH REGARD TO AMENDING THE
EARLY VOTING PLACES AND TIMES AS A RESULT OF THE CHANGE TO A JOINT
ELECTION WITH LUBBOCK INDEPENDENT SCHOOL DISTRICT; AND AMENDING
SECTION 8-4 OF THE CODE OF ORDINANCES WITH REGARD TO THE POLLING
PLACE FOR VOTING PRECINCT NO. 75.
WHEREAS, Lubbock Independent School District has called an election for January
21, 1994, which is the same date for which the City Council of the City of Lubbock has called
an election; and
WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest
of the citizens of the City of Lubbock that the January 21, 1995, special election for the
purpose of voting for or against the adoption of three -eighths (3/8) of one percent sales and
use tax within the City of Lubbock for economic development, including the purchase of
land, construction, maintenance and operation of a multipurpose facility to be used for sports,
athletic, entertainment, tourist and convention and other similar purposes be conducted as a
joint election with Lubbock Independent School District; and
WHEREAS, Cumberland Presbyterian Church has requested that the City of Lubbock
select another location for the Voting Precinct No. 75 polling place; NOW THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT Section 3 of Ordinance No. 9744 enacted on October 14, 1994,
be amended by adding thereto the following sentence.
Said election shall be conducted as a joint election with Lubbock Independent
School District and joint early voting shall be conducted.
SECTION 2. THAT Section 5 of Ordinance No. 9744 enacted on October 14, 1994,
be amended to read as follows:
SECTION 5. THAT joint early voting shall commence on the 3rd day
of January, 1995, and be conducted at the office of the City Secretary on
weekdays, other than City holidays, during the regular hours of business of the
office of the City Secretary, which are from 8:00 A.M. to 5:00 P.M. and at
branch offices for personal appearance at South Plains Mall, 6002 Slide Road;
Lubbock Independent School District Administrative Offices, 1628 19th
Street; Alderson Junior High School, 219 Walnut; Monterey High School,
3211 47th; Coronado High School, 3307 Vicksburg; Lubbock High School,
2004 19th, Estacado High School, 1504 E. Itasca; Texas Tech University
Center on the Texas Tech University Campus; Texas Tech University
Recreation/Aquatic Center on the Texas Tech University Campus, Lubbock
Municipal Coliseum, 4th Street and Boston Avenue; Albertsons Supermarket
No. 4102, 302 University Avenue, United Supermarket No. 543, 8201 Quaker
Avenue; United Supermarket No. 505, 401 Slide Road. The hours and days of
voting at the branch early voting locations are as follows:

Section 8-4 of the Code of Ordinances, Lubbock, Texas, is hereby amended to read as
follows:
The voting place shall be as designated in an appropriate election order.

ORDER AND NOTICE
OF
SPECIAL CITY ELECTIONS
ELECTION ORDER
I, David R. Langston, Mayor of the City of Lubbock, Texas, by virtue of the
authority vested in me by law, and according to the Charter of the City of Lubbock, the
Texas Election Code, the Texas Tax Code, Article 5190.6 of Vernon's Annotated Civil
Statutes, and City Ordinances No. 9744 and No. 9745, enacted on October 14, 1994,
hereby order two Special City Elections for the purpose of voting for or against the
adoption of a sales and use tax for economic development, including the purchase of land,
the construction, maintenance and operation costs of a municipally owned multipurpose
facility to be used for sports, athletic, entertainment, tourist and convention purposes and
activities at the rate of three -eighths (3/8) of one percent and for the purpose of voting for
or against the adoption of an additional sales and use tax within the city at the rate of one -
eighth (1/8) of one percent to be used to reduce the property tax rate to be held
concurrently in the City of Lubbock, Texas, on the 21 st day of January, 1995, such day
being the first succeeding uniform election date available for municipal elections that is
more than thirty (30) days after passage of the ordinances calling these Special Elections.
An electronic voting system and a joint ballot shall be used in such elections,
including early voting. Ballots shall be prepared in accordance with the applicable
provisions of law so that voters may cast their ballots either "FOR" or "AGAINST" the
following measures, which shall appear on the ballot substantially as follows:
PROPOSITION NO. 1
FOR: "THE ADOPTION OF A SALES AND USE TAX
AGAINST: FOR ECONOMIC DEVELOPMENT, INCLUDING THE
PURCHASE OF LAND, THE CONSTRUCTION,
MAINTENANCE AND OPERATION COSTS OF A
MUNICIPALLY OWNED MULTIPURPOSE FACILITY
TO BE USED FOR SPORTS, ATHLETIC,
ENTERTAINMENT, TOURIST AND CONVENTION
PURPOSES AND ACTIVITIES AT THE RATE OF
THREE -EIGHTHS (3/8) OF ONE PERCENT."
PROPOSITION NO. 2
FOR: "THE ADOPTION OF AN ADDITIONAL SALES
AGAINST: AND USE TAX WITHIN THE CITY AT THE RATE
OF ONE -EIGHTH (1/8) OF ONE PERCENT TO
BE USED TO REDUCE THE PROPERTY TAX
RATE."
Said Special City Elections shall be held at the places in the City of Lubbock
hereinafter designated as the voting precincts and the voting places on Exhibit "A" hereto,
which Exhibit "A" shall be made a part hereof for all intents and purposes. Polling places
shall be open from 7:00 A.M. to 7:00 P.M. and all electors shall vote in the precinct of
their residence unless such precinct shall be consolidated with another precinct as provided
herein in Exhibit "A". Said Special City Elections shall be conducted as a joint election
with Lubbock Independent School District and joint early voting shall be conducted.
The persons set forth in Exhibit "B" hereto, which Exhibit `B" shall be made a part
hereof for all intents and purposes, are hereby appointed Judges and Alternate Judges to
hold said Special City Elections on January 21, 1995. Each Presiding Judge so named is
authorized to appoint the number of clerks authorized by the Election Administrator,
which number shall be not less than two (2) clerks, nor more than six (6) clerks. The
Alternate Judges shall serve as Presiding Judges in the event that the regularly appointed
Presiding Judges are unable to serve. The Alternate Judge shall be appointed by the
Presiding Judge to serve as a clerk in the event that the election is conducted by the
regularly appointed Presiding Judge.
Early voting by personal appearance shall commence on the 3rd day of January
1995 and be conducted at the office of the City Secretary on weekdays, other than City
holidays, during the regular hours of business of the office of the City Secretary, which are
from 8:00 A.M. to 5:00 P.M. and at branch offices for personal appearance at South
Plains Mall, 6002 Slide Road; Lubbock Independent School District Administrative
Offices, 1628 19th Street; Alderson Junior High School, 219 Walnut, Monterey High
School, 3211 47th; Coronado High School, 3307 Vicksburg; Lubbock High School, 2004
19th; Estacado High School, 1504 E. Itasca;Texas Tech University Center on the Texas
Tech University Campus; Texas Tech University Recreation/Aquatic Center on the Texas

The sealed ballot box procedure established by Subchapter C, Chapter 127, Texas
Election Code, shall be used for these Special City Elections.
ELECTION NOTICE
The City Secretary of the City of Lubbock is hereby ordered to cause publication
of these Special City Elections by publication of this Order and Notice of Special City
Elections in a newspaper of general circulation published in the City of Lubbock at least
once no earlier than the 30th day or later than the IOth day before election day. In
addition, notice of these Special Elections shall be posted as required by the Texas
Election Code. The City Secretary shall serve a duly certified copy of this Order and
Notice of Special City Elections upon each of the Presiding Judges named in Exhibit "B"
hereto not later than the seventh day after the signing of this Order and Notice of Special
City Elections or the 15th day before the elections, whichever is later.

District, additional early voting locations, and a polling place
change for the City of Lubbock in Lubbock County, Texas,
submitted to the Attorney General pursuant to Section 5 of the
Voting Rights Act of 1965, as amended, 42 U.S.C. 1973c. We
received your submission on November 15, 1994.
The .Attorney General does not interpose any objection to
the specified changes. However, we note that Section 5 expressly
provides that the failure of the Attorney General to object does
not bar subsequent litigation to enjoin the enforcement of the
changes. See the Procedures for the Administration of Section 5
(28 C.F.R. 51.41).

TERMS AND CONDITIONS
DEFINITIONS
On this Airbill, we. our and us refer to Federal Express Corporation, its employees and agents. You
and your refer to the sender, its employees and agents. '
AGREEMENT TO TERMS
By giving us your package to deliver, you agree to all the terms of this Airbill and in our current
Service Guide, which is available upon request. If there is a conflict between the current Service
Guide and this Airbill. the Service Guide will control. No one is authorized to alter or modify the terms
of our Agreement.
RESPONSIBILITY FOR PACKAGING AND COMPLETING AIRBILL
You are responsible for adequately packaging your goods and for properly filling out this Airbill.
Omission of the number of packages and weight per package from this Airbill will result in a billing
based on our best estimate of the number of packages received Item you and an estimated "default"
weight per package, as determined and periodically adjusted by us.
AIR TRANSPORTATION TAX INCLUDED
Our basic rate includes a federal tax required by Inlernal Revenue Code Section 4271 on the air
transportation portion of this service.
LIMITATIONS ON OUR LIABILITY AND LIABILITIES NOT ASSUMED
Our liability for loss or damage to your package is limited to your actual damages or $100.
whichever is less, unless you pay for and declare a higher aulhorized value. We do not provide
cargo liability insurance, but you may pay an additional charge for each additional $100 of declared
value. If you declare a higher value and pay the additional charge, our liability will be the lesser of
your declared value or the actual value of your package.
In any event we will not be liable for any damages, whether direct, incidental, special or
consequential in excess of the declared value of a shipment, whether or not Federal Express had
knowledge that such damages might be incurred including, but not limited to, loss of income or
profits.
We won't be liable for your acts or omissions, including but not limited to improper or insufficient
packing, securing, marking or addressing, or for the acts or omissions of the recipient or anyono else
with an interest in the package. Also, we won't be liable. it you or the recipient violates any of the
terms of our Agreement. We won't be liable for loss of or damage to shipments of prohibited items.
We won't be liable for loss, damage or delay caused by events we cannot control, including but not
limited to acts of God, perils of the air, weather conditions, acts of public enemies, war, strikes, civil
commotion, or acts or omissions of public authorities (including customs and quarantine officials)
with actual or apparent authority.
DECLARED VALUE LIMITS
The highest declared value we allow for FedEx Letter and FedEx Pak shipments is $500, For other
shipments, the highest declared value we allow is $25,000 unless your package contains items of
"extraordinary value,- in which case the highest declared value we allow is $500. Items of
"extraordinary value" include artwork, jewelry, furs, precious metals, negotiable instruments, and
other items listed in our current Service Guide.
If you send more than one package on this Airbill. you may fill in the total declared value for all
packages, not to exceed the $100, $500 or $25,000 per package limit described above. (Example: 5
packages can have a total declared value of up to $125,000.)
If more than one package is shipped on this Airbill, our liability for loss or damage will be limited to
the actual value of the package(s) lost or damaged (not to exceed the lesser of the total declared
value or the per package limits described above). You have the responsibility of proving the actual
loss or damage.
FILING A CLAIM
ALL CLAIMS MUST BE MADE BY YOU IN WRITING. You must notify us of your claim within strict
time limits. See Current Service Guide.
We'll consider your claim filed if you call and notify our Customer Service Department at
800-238-5355 and notify us in writing as soon as possible.
Within 90 days after you notify us of your claim, you must send us all relevant information about it.
We are not obligated to act on any claim unlit you have paid all transportation charges, and you may
not deduct the amount of your claim from those charges.
If the recipient accepts your package without noting any damage on the delivery record, we will
assume that the package was delivered in good condition. In order for us to process your claim, you
must, to the extent possible, make the original shipping cartons and packing available for inspection.
RIGHT TO INSPECT
We may, at our option, open and inspect your packages prior to or after you give them to us to
deliver.
NO C.O.D. SERVICES
NO C.O.D. SERVICES ON THIS AIRBILL. If C.O.D Service is required, please use a Federal
Express C.O.D. airbill for this purpose.
RESPONSIBILITY FOR PAYMENT
Even if you give us different payment instructions, you will always be primarily responsible for all
delivery costs, as well as any cost we may incur in eilher returning your package to you or
warehousing it pending disposition.
RIGHT OF REJECTION
We reserve the right to rejoct a shipment al any time, when such shipment would be likely to cause
damage or delay to other shipments, equipment or personnel, or if the transportation of which is
prohibited by law or is in violation of any rules contained in this Airbill or our current Service Guide.
MONEY -BACK GUARANTEE
In the event of untimely delivery. Federal Express will at your request and with some limitations,
refund or credit all transportation charges- See current Service Guide for further information.
