WHEREAS, the City Council finds that the easement portions hereinafter described in the of this Ordinance are no longer needed for easement purposes and for public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and n the same for easement purposes and for public use; NOW THEREFORE: E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement portions hereinafter described shall BE and the same hereby closed, vacated and abandoned for easement purposes and for public use, being more ,icularly described as follows: A 25 foot Access, Private Drainage, and Underground Utility Easement located in Section 28, Block E-2, Lubbock County, Texas, said easement being recorded in Volume 4261, Page 136, Real Property Records, Lubbock County, Texas, being further described as follows: BEGINNING at a point for the Southeast corner of this easement which bears N. 0°00'30" E. a distance of 20.00 feet and the Southwest corner of Lot 5, Westac, an Addition to the City of Lubbock, Lubbock County, Texas; THENCE N 0000'30" E., along the West line of said Lot 5, Westac a distance of 150.00 feet to a point for the Northeast corner of this easement; THENCE N. 89058'45" W. a distance of 25.00 feet to a point for the Northwest corner of this easement; THENCE S. 0000'30" W., along the East line of Lot 2, Westac a distance of 150.00 feet to a point for the Southwest corner of this easement; , IS w 4758na214 THENCE S. 89058'45" E. a distance of 25.00 feet to the Point of Beginning, SECTION 2. THAT should any section, paragraph, sentence, phrase, clause or word of s Ordinance be declared unconstitutional or invalid for any reason, the remainder of this dinance shall not be affected thereby.
