HomeMy WebLinkAboutOrdinance - 9767-1994 - Abandon And Close A Portion Of Grover Ave. Located In The Spur 327 Business Addt - 12/15/1994First Reading 2nd Reading December 15, 1994 January 12, 1995 Item #14 'I A i1r Item #6 File And a"'"" `��'� �. 1 �j; ?4os.'.i r4a sucY R-O-4W ORDINANCE NO. 9767 AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF GROVER AVENUE LOCATED IN THE SPUR 327 BUSINESS PARK ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the street portions as hereinafter described in the body of this Ordinance are no longer needed for street purposes and public use; and WHEREAS, the City Council finds it would be in the public in the public interest to close, vacate and abandon the same for street purposes and for public use; NOW THEREFORE: !BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street portions as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street purposes and for public use, and being more particularly described as follows: METES AND BOUNDS DESCRIPTION of a Street Stubout to be closed, being the Stub of Grover Avenue at 63rd Street on the South side of 63rd Street, being shown on a plat for Street and Easement Dedications at Spur 327 Autoplex, City of Lubbock Plat File Number 1335.0, and being further described as follows: BEGINNING at the East curb return of the said stub in the South line of 63rd Street, from whence a found iron rod with yellow cap, the Northwest corner of Lot 1, Spur 327, Business Park Addition, as recorded in Volume 3417, Page 248 of the Real Property Records of Lubbock County, Texas, which bears S. 89°58'45" E. a distance of 134.97 feet; THENCE Southwesterly around a 15.00 foot radius curve to the left having a central angle of 90'0I' 15", a chord distance of 21.22 feet; THENCE N. 89058'45" W. a distance of 60.00 feet; THENCE Northwesterly around a 15.00 foot radius curve to the left, having a central angle of 89058'45", a chord distance of 21.21 feet; THENCE S. 89058'45" E. a distance of 90.00 feet to the PLACE OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby.
