Bucy ORDINANCE NO. 9768 AN ORDINANCE ABANDONING AND CLOSING PORTIONS OF 66TH STREET LOCATED IN THE SPUR 327 BUSINESS PARK ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the street portions as hereinafter described in the of this Ordinance are no longer needed for street purposes and public use; and WHEREAS, the City Council finds it would be in the public in the public interest to close, vacate and abandon the same for street purposes and for public use; NOW THEREFORE: !BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the street portions as hereinafter described shall BE and the same are hereby closed, vacated and abandoned for street purposes and for public use, and being more particularly described as follows: BEGINNING at a '/2" rod with orange cap marked RPLS #4460 set at the Southeast corner of this tract, from whence the Southwest corner of Lot 2, Spur 327, Business Park Addition to the City of Lubbock, Lubbock County, Texas, as recorded in Volume 3637, Page 190 of the Real Property Records of Lubbock County, Texas, which bears S. 89°58'45" E., a distance of 70.00 feet and North, a distance of 200.02 feet; THENCE N. 89059' W., a distance of 60.00 feet to a'/2" rod with cap set; THENCE North, a distance of 8.00 feet; THENCE S. 89059' E., a distance of 60.00 feet; THENCE South, a distance of 8.00 feet to the PLACE OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. vex 4780PACE307 SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
