HomeMy WebLinkAboutOrdinance - 9770-1994 - Amend Chapter 2 Of Code Of Ordinances Regarding Fire/Police Appointments - 12/15/1994First Reading Second Reading December 15, 1994 January 12, 1995 Item #26 Item #9 ORDINANCE NO. 9770 AN ORDINANCE AMENDING CHAPTER 2 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO APPOINTMENT OF MEMBERS OF THE FIREMEN'S AND POLICEMEN'S CIVIL SERVICE COMMIS- SION; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, Section 143.006(b)of the Texas Local Government Code requires appointment of members to the City of Lubbock Firemen's and Policemen's Civil Service Commission to be made by the chief executive of the municipality; and WHEREAS, the above cited statutory language is not matched by the language of Section 2-212 of the Code of Ordinances of the City of Lubbock; and WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to conform the City Code provision to the state law; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 2-212 of the Code of Ordinances, City of Lubbock, Texas, is hereby amended to read as follows: Sec. 2-212. Members --Appointment; vacancies. Members of the Firemen's and Policemen's Civil Service Commission shall be appointed by the Chief Executive of the municipality, and such appointments shall be confirmed by the City council before such appointments shall be effective. Any vacancies in the Firemen's and Policemen's Civil Service Commission, caused by death, resignation or otherwise, or by failure of any appointee to qualify within ten (10) days after appointment, shall be filled in the manner specified in this section, and such appointment shall be for the unexpired term of the retiring commissioner or the appointee failing to qualify. SECTION 2. Should any paragraph, section, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 3.
