Home My WebLink AboutOrdinance - 9722-1994 - Amend Chapter 26-22 Of Subsection D/ Hotel/Motel Taxes - 10/13/1994First Reading Second Reading August 11, 1994 October 13, 1994 Item #22 Item #6 ORDINANCE NO. 9722 AN ORDINANCE AMENDING CHAPTER 26, SECTION 26-22 OF THE CODE OF ORDINANCES BY AMENDING SUBSECTION (c) WITH REGARD TO EXCEPTIONS FOR HOTEL/MOTEL TAXES; AND BY DELETING SUBSECTION (d); AND PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to amend Chapter 26, Section 26-22, in order to bring it in conformity with Chapter 351 of the Tax Code, which exempts only certain persons from paying hotel/motel taxes; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT Section 26-22 of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended Subsection (c) to read as follows: (c) No tax shall be imposed under this article when State law provides an exemption from this tax. SECTION 2. THAT Section 26-22 of the Code of Ordinances of the City of Lubbock, Texas, is hereby amended by deleting therefrom subsection (d). SECTION 3. THAT should any paragraph, sentence, clause, phrase or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method of publication provided by law.
