HomeMy WebLinkAboutOrdinance - 9723-1994 - Abandon And Close Portions Of Two Alleys Located In Section 4, Block 0 - 08/25/19944680FAGE 4 30505 File An6 R041 rr to First Reading Council Date 08/25/94 Item No. 10 Second Reading Council Date 09/08/94 Item No. 6 ORDINANCE NO. 9723 AN ORDINANCE ABANDONING AND CLOSING THE FOLLOWING PORTIONS OF ALLEYS: TWO (2) FIFTEEN FOOT ALLEYS LOCATED IN THE SOUTHWEST QUARTER OF SECTION 4, BLOCK O, IN THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the alley portions hereinafter described in the body of this Ordinance are no longer needed for alley purposes and for public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for alley purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the alley portions hereinafter described shall BE and the same is hereby closed, vacated and abandoned for alley purposes and for public use, being more particularly described as follows: METES AND BOUNDS DESCRIPTION for two (2) 15.00 foot alleys out of the Southwest Quarter of Section 4, Block O, Lubbock, Lubbock County, Texas, and being further described as follows: BEGINNING at the Northwest corner of Lot 1, Zahn Addition to the City of Lubbock, Lubbock County, Texas; THENCE South, along the West line of Lot 1, Zahn Addition, a distance of 217.50 feet to the Southwest corner of said Lot 1, Lubbock, Lubbock County, Texas; THENCE Southwesterly along the projection of the North line of Idalou Road, a distance of 16.70 feet; THENCE North, a distance of approximately 54.80 feet; THENCE West, a distance of 132.50 feet; THENCE North, a distance of 15.00 feet; THENCE East, a distance of 122.50 feet; THENCE N. 45' E., a distance of 14.14 feet; VOL 4680?AGE 5 THENCE North, a distance of 145.00 feet; THENCE East, a distance of 15.00 feet to the PLACE OF BEGINNING. SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
