HomeMy WebLinkAboutOrdinance - 9724-1994 - Abandon And Close A 30-Ft Access Easment - 08/25/199430508 File And Return To Ed, Bsicy P'_O..w First Reading August 25, 1994 Item # 11 Second Reading September 8, 1994 Item #7 YOt 4686?AGE 9 ORDINANCE NO. 9724 AN ORDINANCE ABANDONING AND CLOSING A 30 FOOT ACCESS EASEMENT LOCATED IN SECTION 28, BLOCK E-2, LUBBOCK COUNTY, TEXAS AND RECORDED IN VOLUME 3237, PAGE 122 OF THE OFFICIAL REAL PROPERTY RECORDS OF LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. WHEREAS, the City Council finds that the easement portion hereinafter described in the body of this Ordinance is no longer needed for easement purposes and for public use; and WHEREAS, the City Council finds it would be in the public interest to close, vacate and abandon the same for easement purposes and for public use; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT the easement portion hereinafter described shall BE and the same is hereby closed, vacated and abandoned for easement purposes and for public use, being more particularly described as follows: METES AND BOUNDS DESCRIPTION of a 30 foot access easement located in Section 28, Block E-2, Lubbock County, Texas, being further described as follows: BEGINNING at a point which bears N. 00°00'30" E., 1822.50 feet and S. 89058'45" E., 592.55 feet from the Southwest corner of Section 28, Block E-2. Lubbock County, Texas. THENCE N. 00001'35" E. a distance of 170.00 feet; THENCE 89058'45" E. a distance of 30.00 feet; THENCE S. 00001'35" W. a distance of 170.00 feet; THENCE N. 89058'45" W. a distance of 30.00 feet to the Point of Beginning. No Text SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the official maps of the City of Lubbock to reflect said abandonment and closing, showing the number of this Ordinance and the date of its final passage. SECTION 3. THAT should any section, paragraph, sentence, phrase, clause or word of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this Ordinance shall not be affected thereby. SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized and directed to cause publication of the descriptive caption of this Ordinance as an alternative method provided by law.
