HomeMy WebLinkAboutOrdinance - 9744-1994 - Ordinance For A Special Election For Adoption Of Sales Taxes - 10/13/1994First Reading Second Reading October 13, 1994 October 14, 1994 Item #43 Item #4 ORDINANCE NO. 9744 AN ORDINANCE ORDERING A SPECIAL ELECTION TO BE HELD ON JANUARY 21, 1995, FOR THE PURPOSE OF VOTING FOR OR AGAINST THE ADOPTION OF THREE -EIGHTHS (3/8) OF ONE PERCENT SALES AND USE TAX WITHIN THE CITY OF LUBBOCK FOR ECONOMIC DEVELOPMENT; INCLUDING THE PURCHASE OF LAND, THE CONSTRUCTION, MAINTENANCE AND OPERATION COSTS OF A MUNICIPALLY OWNED MULTIPURPOSE FACILITY TO BE USED FOR SPORTS, ATHLETIC, ENTERTAINMENT, TOURIST AND CONVENTION PURPOSES AND ACTIVITIES PURSUANT TO SECTION 4B OF ARTICLE 5190.6 OF VERNON'S ANNOTATED CIVIL STATUTES; MAKING PROVISION FOR THE CONDUCT OF SUCH ELECTION ACCORDING TO APPLICABLE PROVISIONS OF LAW; PROVIDING FOR EXECUTION OF AN APPROPRIATE ELECTION ORDER HEREAFTER; AND OTHER PROVISIONS INCIDENT TO AND RELATED TO THE PURPOSE HEREOF. WHEREAS, the City Council of the City of Lubbock deems it to be in the best interest of the citizens of the City of Lubbock to order a special election to be held on January 21, 1995, for the purpose of voting for or against the adoption of three -eighths (3/8) of one percent sales and use tax for the purchase of land, construction, maintenance and operation of a multipurpose facility to be used for sports, athletic, entertainment, tourist and convention and other similar purposes pursuant to Section 4B of Article 5190.6, Vernon's Annotated Civil Statutes; NOW THEREFORE: BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. THAT a Special Election be held on the 21 st day of January, 1995, which date is the next succeeding uniform election date available for municipal elections for which sufficient time elapses for the holding of an election after passage of this Ordinance. Said election shall be held to determine whether three -eighths (3/8) of one percent sales and use tax should be imposed within the City of Lubbock for economic development pursuant to Section 4B of Article 5190.6 of Vernon's Annotated Civil Statutes. SECTION 2. THAT an electronic voting system shall be used in this election, including early voting. Ballots shall be prepared in accordance with the applicable provisions of the Election Code so that voters may cast their ballots either "for" or "against" the measure, which shall appear on the ballot substantially as follows: PROPOSITION NO. 1 FOR: "THE ADOPTION OF A SALES AND USE TAX FOR AGAINST: ECONOMIC DEVELOPMENT, INCLUDING THE PURCHASE OF LAND, THE CONSTRUCTION, MAINTENANCE AND OPERATION COSTS OF A MUNICIPALLY OWNED MULTIPURPOSE FACILITY TO BE USED FOR SPORTS, ATHLETIC, ENTERTAIN- MENT, TOURIST AND CONVENTION PURPOSES AND ACTIVITIES AT THE RATE OF THREE -EIGHTHS (3/8) OF ONE PERCENT". SECTION 3. THAT the election shall be held at the voting places set forth in an appropriate election order to be issued by the Mayor hereafter and all persons qualified to vote in the City of Lubbock under the election laws of the State of Texas shall be allowed to vote therein. Said Special Election shall be held and the polling places shall be open from 7:00 A.M. to 7:00 P.M. and all electors shall vote in the precinct of their residence unless otherwise provided in the election order. The sealed ballot box procedure established by Subchapter C, Chapter 127, Texas Election Code shall be used for this election. SECTION 4. THAT notice of this election shall be published in a newspaper of general circulation published in the City of Lubbock by publication of this Ordinance in its entirety at least once not earlier than the 30th day or later than the 1 Oth day before election day. In addition, notice of the election shall be posted as required by the Texas Election Code. SECTION 5. THAT early voting shall commence on the 3rd day of January 1995 and be conducted at the office of the City Secretary on weekdays, other than City holidays, during the regular hours of business of the office of the City Secretary, which are from 8:00 A.M. to 5:00 P.M. and at branch offices for personal appearance at South Plains Mall, 6002 Slide Road, Lubbock, Texas; Alderson Junior High School, 219 Walnut, Lubbock, Texas; Monterey High School, 3211 47th, Lubbock, Texas; Albertsons Supermarket No. 4102, 302 University Avenue, Lubbock, Texas; and United Supermarket No. 543, 8201 Quaker Avenue, Lubbock, Texas; United Supermarket No. 505, 401 Slide Road, Lubbock, Texas.
