Said Agreement is attached hereto and incorporated in resolution as if fully set forth herein and shall be included in the minutes of the City Council. The Consultant has entered into the Agreement with the City for performing professional services associated with the Southeast Water Reclamation Plant, Plant 3 Improvements. City desires Engineer, and Engineer agrees to perform, additional services associated with the replacement of 30-inch and 39-inch PCCP piping, as set forth in Exhibit "A", attached to and incorporated herein. This Amendment No. 1 increases the original Agreement, contract 15511, an additional fifty-six thousand seven hundred and four and NO/100 dollars ($56,704.00) and grants a term extension of six (6) months for the performance of services set forth herein. All other portions of the original Agreement shall remain in place and are not altered by this amendment. Vice President Scott Hoff, P.E., Senior Vice President APPROVED AS TO FORM: elli Leisure, Assistant City Attorney Page 2 of 2 f EXHIBIT A CONSTRUCTION PHASE SERVICES — AMENDMENT 1 FOR CITY OF LUBBOCK, TX SOUTHEAST WATER RECLAMATION PLANT PLANT 3 IMPROVEMENTS PROJECT BACKGROUND The Southeast Water Reclamation Plant (SEWRP) operates two liquid stream treatment trains: Plant 3 featuring conventional activated sludge, and Plant 4 featuring an IFAS process for biological nutrient removal. The original construction of Plant 3 occurred in the 1960s and 1970s, with some improvements being made in the mid-1990s. Plant 3 is generally in need of rehabilitation and upgrades to improve treatment performance, reduce maintenance requirements, and extend the service life of the treatment train. The City of Lubbock (CITY) elected to move forward with a Phase 1 project to replace the air header and air distribution piping between the aeration blowers and the diffusers, upgrade the secondary clarifiers, upgrade pumping of RAS and WAS, and improve secondary scum handling. The CITY authorized the ENGINEER to provide design services and prepare Contract Documents for construction of the Plant 3 Improvements Project in December 2017. The design was completed in August 2019, and proposals were received from qualified Construction Contractors in January 2020. The selected General Contractor was excavating to locate return activated sludge piping to be reconnected to new piping when it was discovered that upon removing the overburden on the influent line to the Plant 3 aeration basins to a sufficient depth the excavation began to fill with water coming from the influent line. After a significant pumping and isolation effort on the part of the General Contractor, it was determined that the original 39-inch pre -stressed concrete cylinder pipe (PCCP) installed in 1970 had seven large holes in the pipe crown within the length of the initial excavation alone. Further uncovering of the line both upstream and downstream of the original excavation exposed more holes in the pipe crown. Based upon the condition of the pipe, there is a need to replace all 30-inch and 39-inch PCCP pipe between the Plant 3 primary clarifiers and the aeration basins. This piping was not originally a part of the project, as this piping was expected to have remained full at all times, and therefore would not be expected to exhibit crown corrosion in the way that it has. PURPOSE This EXHIBIT A establishes the Scope of Work, the Time of Performance, and the Engineering Services Budget for additional Construction Phase Services to be provided by the ENGINEER for the CITY as a result of the unforeseen need to replace the pipelines between the primary clarifiers and the aeration basins. This additional work requires an 8-week extension in the project contract time, and associated additional engineering review time, meetings, and drawing production. The engineering services will consist of the following: • Section 900 — Special Services January 5, 2021 - Exhibit A - Contract No. 13422 PAGE 1 of 2 r f,�® F`�,�-&�� sue,.` •-VI s ' SECTION 900 SPECIAL SERVICES Task 905 - Major Changes/Unforeseen Conditions ENGINEER and RPR will provide additional services associated with replacement of the 30-inch and 39-inch PCCP piping between the primary clarifiers and aeration basins. 1. Provide additional on -site RPR services for 20 hours per week for a period of eight weeks. See Exhibit C for the Subconsultant's proposal. 2. ENGINEER to attend two additional meetings, perform additional submittal review and RPR support, and provide updated Record Drawings reflecting the new piping, and changes to the original RAS pump station design. CONSTRUCTION PERIOD The Scope of Work presented herein covers work -related tasks that will be required for an additional contract period of 6 months, extending the Contract to April 11, 2023. As established with the original Scope of Works, should the construction period exceed the allotted time, an Amendment to this Contract may be required to extend the Field Services through completion of construction. CITY and ENGINEER agree to review the Contractors progress on a quarterly basis to determine ENGINEER staffing needs required to complete the project and make adjustments to the budget as needed. BUDGET CITY and ENGINEER have established a not -to -exceed budget of $56,704 to complete all services under this EXHIBIT A. This amount will not be exceeded without a contract amendment. CITY will pay the ENGINEER hourly, for services identified in EXHIBIT A. Subconsultant services will be billed at cost to ENGINEER with a 5 percent handling fee. The budget for each Task is presented in EXHIBIT B. CITY and ENGINEER agree to allow redistribution of funds between Tasks as appropriate to allow flexibility in providing the needed services within the not -to -exceed budget. ENGINEER agrees to complete these services as delineated above. Should there be a Change in Scope of Work or Time of Performance, then this can result in an amendment to this contract, which will be negotiated at that time. The level of construction services provided by the ENGINEER is highly dependent on the Contractor. Consequently, the CITY and ENGINEER agree to review the job progress at the midpoint period and at the 75 percent complete point to determine the effort required to complete job tasks and make appropriate adjustments to the budget as needed.
