ORDINANCE NO. 2021-00015
AN ORDINANCE AMENDING THE FY 2020-21 BUDGET FOR MUNICIPAL PURPOSES
RESPECTING THE GRANT FUND TO ACCEPT AND APPROPRIATE FUNDING FROM
THE UNITED STATES TREASURY DEPARTMENT EMERGENCY RENTAL
ASSISTANCE PROGRAM AND THE CORONAVIRUS AID, RELIEF, AND ECONOMIC
SECURITY ACT (CARES) FOR TEXAS DEPARTMENT OF HOUSING AND
COMMUNITY AFFAIRS (TDHCA) COMMUNITY DEVELOPMENT BLOCK GRANT
(CDBG); PROVIDING FOR FILING; AND PROVIDING FOR A SAVINGS CLAUSE.
WHEREAS, Section 102.010 of the Local Government Code of the State of Texas
authorizes the City Council to make changes in the budget for municipal purposes; and
WHEREAS, in accordance with the City Budget Ordinance the City Council shall
approve all transfers between funds; and
WHEREAS, the City Council deems it advisable to change the FY 2020-21 Budget for
municipal purposes and reallocate funds as follows; NOW, THEREFORE,
WHEREAS, on March 16, 2020, the Mayor of the City of Lubbock issued a Declaration
of Disaster for the City of Lubbock regarding the novel coronavirus (COVID-19) epidemic and
the City Council of the City of Lubbock passed a resolution continuing and affirming the
Mayor's Declaration of Disaster, and said Declaration of Disaster was continued and affirmed
on April 28, 2020; and
WHEREAS, in accordance with Article IX, Section 16 of the City of Lubbock Charter,
the City Council finds that there is an emergency situation and must ensure that his Ordinance is
passed on first reading; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the City Council of the City of Lubbock hereby approves changes
to the City of Lubbock Budget FY 2020-21 (Budget Amendment #10) for municipal purposes,
as follows:
I. Accept and appropriate $7,821,801.70 from the U.S. Treasury Department for
Emergency Rental Assistance Program.
II. Accept and appropriate $476,858.66 from the Texas Department of Housing and
Community Affairs for Coronavirus Aid, Relief, and Economic Security Act Community
Development Block Grant.
SECTION 2. THAT a copy of the changes made to the City of Lubbock Budget
pursuant to this Ordinance shall be filed with the City Secretary and County Clerk of Lubbock
as required by law.
SECTION 3. THAT should any section, paragraph, sentence, clause, phrase or word of
this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 4. THAT this Ordinance shall take effect and be in effect immediate after
its passage as an emergency measure.
AND IT IS SO ORDERED
Passed by the City Council by unanimous vote on the first and only reading as an
emergency on February 9 , 2021.
