RESOLUTION

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Contract for
Professional or Technical Services with the Urban.Renewal Agency of Lubbock,
Texas, for the Fifth Year Community Development Program, attached herewith
which shall be spread upon the minutes of the Council and as spread upon the
minutes of this Council shall constitute and be a part of this Resolution as
if fully copied herein in detail.
Passed by the City Council this 22nd day of February ,1979.

CONTRACT FOR PROFESSIONAL OR TECHNICAL SERVICES

PART 1 - AGREEMENT
THIS AGREEMENT entered into. as of this 22nd day of February ,
1979, by and between the City of Lubbock, Texas, hereinafter referred to as. the
"Contractor," and the Urban Renewal Agency of the City of Lubbock, Texas, here-
inafter referred to as the "Local Public Agency," for the services of the Com-
munity Services Department.
WITNESSETH:
WHEREAS, the Local Public Agency has, under date of May 25, 1978 ,
entered into a Contract with the City of Lubbock, Texas, to do and perform certain.
services in its undertaking.of a Community Development Plan pursuant to the
Housing and Community Development Act of 1974; and
WHEREAS, the Local Public Agency desires to engage the Contractor to render
certain technical service and assistance in connection with such undertakings
as assumed by the Local Public Agency;
NOW, THEREFORE, the parties do mutually •agree as follows:
A. Scope of Services: The Contractor shall provide the following: -
1. Perform field surveys of families and/or individuals and dwel-'
ling units using a form provided by the Local Public Agency
at locations specified by the Local Public Agency.
2. Submit one copy of the completed surveys to the Local Public
Agency
B. Time of.Performance: ._The services of the Contractor are to commence
upon the 2 6 th day .of February , 1979, and shall be under-
taken and completed in such sequence as to assure their expeditious
k completion in the light of the purposes of the..Contract and in.accord-
ance with the work activities schedule, but in any event, all of the
services required hereinunder for.the survey of -the action year pro-
ject areas shall be completed within 20 consecutive calendar days
from the date of the Contract.
C. Compensation:. The compensation for the Relocation Housing Study
shall be on the basis of $10.00per completed survey, not to exceed
$850.00 and shall include all items in the Scope of Services
! shown in this Contract.
D. The Contractor shall not discriminate against any employees or ap-
plIcant for employment because of race, color' religion, sex, age,
or national origin. The Contractor shall take affirmative action
to ensure that applicants are employed, and employees are treated
during employment, without regard to race, color, religion, sex,
age, or national origin.- Such action shall include, but not be
limited to, the following: employment, upgrading, demotion, or
transfer; recruitment or recruitment advertising; layoff or term-
ination; rates of pay or other'forms of compensation; and selection
for training, including apprenticeship. The Contractor agrees to
post in conspicuous places, available'to employees and applicants
for employment, notice to be provided by the Local Public Agency
setting forth the provisions of this nondiscrimination clause.
The Contractor will, in all solicitations or advertisements for
employees placed by or on behalf of the Contractor, state that all
qualified applicants will receive consideration for employment with-
out regard to race, color, religion, sex, or national origin.
E. All of the reports, information, data, etc., prepared or assembled
by the Contractor under this Agreement are confidential and the Con-
tractor agrees that they shall not be made available to any indivi-
dual or organizationwithout the prior written.approval of the Local
Public Agency.
F. The Contractor shall comply with all applicable laws, ordinances,
or codes of the State or local governments, in performing any of
the work embraced by this Agreement.
G. If,. through any'cause, the Contractor shall fail to fulfill in
timely and proper manner his obligations under this Agreement, or if
the Contractor shall violate any of the covenants, agreements, or
stipulations of this Agreement, the Local Public Agency shall there-
upon have the right to terminate this. Agreement by giving written,
notice to the Contractor of such termination and specifying the
effective; date thereof, at least five (5) days before the effective
date of such termination. In such event, all finished or unfinished
documents, data, and reports prepared by the Contractor under this
Agreement shall, at the option of the Local Public Agency, become
its -property and the Contractor shall be entitled to receive just
and equitable compensation for.any satisfactory work completed on
such.documents.

RESOLUTION APPROVING A CONTRACT BETWEEN THE CITY OF LUBBOCK AND
THE URBAN RENEWAL AGENCY OF THE CITY OF LUBBOCK FOR THE SERVICES f
OF THE COMMUNITY SERVICES DEPARTMENT '
WHEREAS, the Fifth Year Community Development Program includes certain
areas approved for urban rehabilitation and redevelopment activities; and
WHEREAS, said activities will involve the purchase, clearance and
relocation of persons occupying dilapidated housing units; and
WHEREAS, :the Urban Renewal Law of the State of Texas requires that the
s displacement and relocation of persons cannot be carried out unless a
feasible method exists for the rehousing of persons displaced by Urban
Renewal activities in decent, safe and sanitary dwelling units within
their means and without undue hardship to such persons; and
WHEREAS, surveys of all families and individuals occupying housing
units designated for purchase and clearance must be made to prepare a
Relocation Plan that meets these requirements; and
j WHEREAS, the staff members of the Urban Renewal Agency qualified to '
perform such surveys are actively engaged in the execution of Fourth Year
Community Development activities and are not currently available for this

survey work; and

WHEREAS, it is necessary due to the timing of the Uniform Act Relocation
eligibility requirements to conduct the surveys during the month of February;
} and
WHEREAS, the Community Services Department of the City of Lubbock has
ji a staff qualified, willing and able to perform such surveys of families
and individuals;

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE
URBAN RENEWAL AGENCY OF THE CITY OF LUBBOCK:
I' THAT a contract attached hereto and designated as "Exhibit A" and
IE made a part hereof between the City of Lubbock and the Urban Renewal
Agency of the City of Lubbock for the services of the Community
Services Department be and is hereby approved and that the Chairman
be and is hereby authorized and directed to execute the contract on
behalf of the Urban Renewal Agency of the City of Lubbock.
On motion of Commissioner Hassell ,seconded by Commissioner
Braxton , the above and foregoing Resolution was passed this 20th;
day of February 1979, by the following vote:
