Ross, Jr., City Attorney AS TO CONTENT: A.I.11A irector-of Publioc Services AGREEMENT BETWEEN METHODIST HOSPITAL and CITY OF LUBBOCK WHEREAS: TIED TO RESO. #92 - 3/8/79 The City of Lubbock, Texas, acting by and through the City Health Department, having available obstetrical facilities desirable for the education of nursing students, offers these facilities to Methodist Hospital for use by senior nursing students of Methodist Hospital School of Nursing. JOINT AGREEMENTS 1. The City Health Department will provide the use of its obstetrical clinical facilities, obstetrical home visits and V.D. Clinic, and the School of Nursing will furnish qualified instructional staffand students. 2. Both parties to this agreement will cooperate in order to provide the nursing students with proper learning situations and -in order to _maintain good patient care. Times for use of the facilities will be planned and agreed upon by the respective directors of the City Health Department and the School of Nursing. 3. Scheduling and use of the clinical facilities will be coordinated by joint consideration of the availability of the facilities and clinical.material. 4. Nothing herein shall be construed as creating the relation- ship of employer and employee between the City of Lubbock and Methodist Hospital employees of School of N»rsing students. 'In carrying out this agreement, Methodist Hospital shall select its own employees and nursing students and such employees and students shall be and act under the exclusive and complete supervision and control of Methodist Hospital. 5. This agreement shall be evaluated and reviewed annually by both parties and revisions may be made whenever considered necessary by mutual agreement. 6. Either party may at its option terminate this agreement by giving 30 days written notice to the appropriate director of the opposite party. DUTIES OF METHODIST HOSPITAL SCHOOL OF NURSING 1. Assign for clinical experience only students who are in good health and who have had a physical examination within the previous 12 months. 2. .-3. 4. 5. Provide qualified instructors for -.the clinical -nursing laboratory periods. Be responsible through its instructors for assigning, super- vising and guiding students in appropriate learning situations as related to the nursing curriculum. Abide by the policies of the City Health Department while using its facilities, including meeting all standards for patient care.. Abide by all applicable federal, state and local laws, ordinances and regulations and save harmless the City of Lubbock from any claim arising from the violation of any such laws, ordinances or regulations whether by Methodist Hospital employee or student, 6. Provide the City Health Department with information regarding student level and distribution, including a master rotation and instructor assignments. 7. Cooperate with the appropriate City Health Department per- sonnel when assigning and directing student activity in the clinical situation. 8. Be responsible through its faculty for all evaluating and counseling of students with regard to performance. 9. Continue to meet .the standards of the Texas Board of Nurse Examiners, the National League for Nursing and the J.C.A.H. 10. Indemnify and hold the City of Lubbock harmless from any and all loss or damage and from all claims for injury, death, loss or damage of any kind whatsoever, and by whomsoever claimed or asserted, occasioned by or in connection with any acts of Methodist Hospital employees or School of Nursing students in connection with this agreement. DUTIES OF THE CITY OF LUBBOCK HEALTH DEPARTMENT 1. Provide necessary physical obstetrical facilities, obstetrical home visits and V.D. Clinic facilities for the clinical lab- oratory experience of students of the School of Nursing. 2. Allow the use of teaching equipment owned by the City Health Department, provided such use is limited to the premises of the City Health Department. 3. Orient the faculty to City Health Department facilities and policies through joint meetings and other appropriate means, including keeping the faculty informed of changes in policies and procedures as required. '4. Allow surveyvisitors from the School's accrediting organi zations to visit the'.facilities in connection with the School's Accreditation Visit. 5. Accept all students within the number agreed upon during the time this agreement is in effect. This number is twenty (20) students each rotation for each of four (4) rotations. 6. Insure.that no student is moved.from assignments made by the faculty without first obtaining the consent and approval 'of the instructor. Executed this 8th of March ,1979.
