BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
�,. THAT the Mayor of the Cit of Lubbock BE and is hereby authorized and

directed to execute for and on behalf of the City of Lubbock, Change Order
#1 to H.C. Lewis contractor, for terminal parking structure at the Lubbock
International Airport, attached herewith which shall be spread upon the
�,- minutes of the Council and as spread upon the minutes of this Council shall
constitute and be a part of this Resolution as if fully copied herein in
detail.
Passed by the City Council this 22nd day of February ,1979.

Terminal Parking Structure
Lubbock International Airport
Lubbock, Texas

General description of work included in contract:
Two-level precast concrete parking structure, including concrete pavement at
ground level, concrete ramp, precast concrete upper deck, 2 attendant buildings,
signs, lighting, hose bibbs, painting of parking areas and miscellaneous other items
of construction as more fully described in the construction documents.
Change in Contract Price . . . . . . . . . . . . . . . . . . None
WHEREAS, it is desirable to provide written agreement whereby payment can be made
for precast concrete materials stored off site in accordance with Article 5 of the
Standard Form of Agreement Between Owner and Contractor:
THIS AGREEMENT WITNESSETH: In consideration of the mutual advantage gained, the
Owner and the Contractor agree to the following conditions:
1. Check for the payment for precast concrete materials will be issued jointly
to H.C. Lewis, General Contractor, and The Featherlite Corporation.
2. H.C. Lewis, General Contractor, agrees to replace any materials which are
damaged in transit or which are found to be unsuitable in the opinion of
the Architect for incorporation in the project.
3. Consent of Surety for payment of materials stored off site is to be granted
as evidenced by a letter to be attached hereto.
4. Title to the precast concrete materials shall pass jointly to the City of
Lubbock and H.C. Lewis, General Contractor upon receipt of payment, with the
provision that sole title to said materials shall pass to the Owner upon
final acceptance of the project.
5. Precast concrete materials shall be covered by adequate insurance protecting
the interests of the Owner and the General Contractor while stored off the
site, while in transit and at the job site.

6. General Contractor certifies that he has inspected the materials for which
he requests payment and finds them to be in conformance with the contract
documents in so far as can be determined by visual examination and certi-
fication by the fabricator.
Except as modified above, all other stipulations and covenants contained in the
contract remain unchanged.
The Owner and the Contractor agree that there will be no adjustment to the time
allowed for completion of the project for the above listed conditions.
IN WITNESS WHEREOF, the Owner and the Contractor have hereto set their hands this
the 22nd day ofFebruary , 1979.
