HomeMy WebLinkAboutResolution - 108 - Stipulation & Disclaimer - SWPSC - #4294 Proceeding, Eminent Domain - 03/22/1979�!• JWF:hw RESO. #107 (3/22 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the CITY MANAGER of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an oil and gas well drilling permit to Lawrence Barker, Jr., for the Lulain Estate No. 3, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. S WHITE, Et Al S BAILEY COUNTY, TEXAS STIPULATION This stipulation of the undersigned parties shall be carried forward into and made a part of the final judgment in this case. It is not the purpose or intention of Petitioner, SOUTHWESTERN PUBLIC SERVICE COMPANY, in this proceeding to take, hold, or acquire any water rights interest -of the CITY OF LUBBOCK, which said CITY owns by reason of and pursuant to any instrument executed and recorded in the public records of Bailey or Lamb County, Texas, in favor of said CITY conveying to it any right, title, or interest, of whatsoever kind or nature, affecting water rights and all ancil- lary and incidental uses to such water rights, in all or in part, of League 206, Ochiltree County School Lands in Bailey and Lamb Counties in the State of Texas. The rights and ownerships of the CITY OF LUBBOCK are no more affected in these premises than if said Petitioner had never brought this proceeding in Court as against said CITY OF LUBBOCK. In consideration of the terms of this stipulation, the CITY OF LUBBOCK disclaims any interest in the proceeds which may be awarded in this proceeding or on any appeal.
