HomeMy WebLinkAboutResolution - 165 - Addendum To Agreement - ATC - Lease Management, Transit Programs - 05/24/1979Z � DGV:hw RESO #165 - 5/24/79 -w RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Addendum to a Lease Management Agreement executed between American Transit Corporation and the City of Lubbock November 18, 1976, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. City'Attorney P P DENZEL FE:1101YULL, Dir, ctor, Public Services TIED TO KESO #165 - 5/24/79 ADDENDUM This Addendum made this 24th day of May , 1979, by and through the Lubbock Transit Division of American Transit Corporation, acting by and through its President, hereinafter called the "Contractor", and the City of Lubbock, County of Lubbock, Texas, hereinafter called the "City"; WITNESSETH WHEREAS, on November 18, 1976, an agreement was entered into by and be- tween the above mentioned parties, which agreement provided for services re- lative to the City's transit programs, and; WHEREAS, the contractor desires to clarify the aforesaid agreement to further signify and reaffirm its intent under such agreement; NOW THEREFORE: It is hereby agreed that the Lubbock Transit Division of American Transit Corporation hereby acknowledges and agrees that it shall comply with all terms and conditions of Urban Mass Transportation Adminis- tration grant contracts between the United States and the City of Lubbock, Texas, the City's applications, assurances, and all other applicable laws and regulations which may apply in carrying out the accomplishment of the programs. This Addendum, together with the Lease Management Agreement, contains all the agreements of the parties. In witness whereof, the Lubbock Transit Division of American Transit Corporation and the City of Lubbock, Texas, have caused these presents to be executed this 24th day of May , 1979. Cunningham, City Manager FROM: Denzel Percifull, Director of Public Services May 21, 1979 SUBJECT: Committee Recommendation on Transit Management Firm Proposals Following your instructions, a committee comprised of Jim Blagg, Sterling Miller, Jim Bertram, John Wilson and myself carefully reviewed the proposals submitted by ATC (current trans i t management firm), and ATE. The proposals were reviewed in a similar fashion to the reviews done on architectural' pro- posals (necessarily based on specific criteria relating to proper management of transit,systems). Criteria used in reviewing and rating the two (2) proposals were personnel qualifications (experience and background, resource personnel available, general personnel experience); the experience of the firm (being with local municipalities, effectiveness of management of current properties, current properties under contract, planning support, knowledge UMTA requirements); and methodology (under- standing of concept of job to be performed, willingness to work with Transit Department, proposal compliance with set criteria for operation, and plan of approach). Based on this rating outline, the five members of the committee rated ATE at 94.43, and ATC at 77.33• The committee feels ATE best fits the City's needs because they are offering on-site budgeting the financial accounting, whereas ATC is presently using and proposing this function to continue to be done in St. Louis. The proposal sub- mitted by ATE was definitely more positive and oriented toward making the transit system successful (meeting the demand at the lowest possible cost) rather than just providing management. ATE with their proposal (one man manage- ment) would provide the City with the capability to be in the position to make an easy transition into the complete management of the transit system, were the Council to decide in the future that this route would be in the best interests of the City. Besides the very positive approach of ATE's entire proposal, a representative of ATE visited Lubbock and assessed the present system of operation. As a result of this visit, ATE made the decision that one (1) top quality transit manager, with the necessary financial and clerical support as well as the support which ATE would provide, could perform the work of management of the transit system. The representative based this decision on his feeling that'John Wilson and the Transit staff were doing much of the work which the existing management firm should be doing. f r s Larry J. Cunningham, City Manager May 21, 1979 Page 2 The committee also feels that with the Transit System potentially undergoing changes in citizen attitude, etc., the ATE proposal, with their large, home office planning staff, as well as a permanent office in Washington D.C., would be in a position to provide much additional expertise in the necessary dealings with UMTA. In addition, there are seven (7) present ATE properties that are involved in a new facility construction project very similar to what the City plans with respect to the acquired Ford Building northeast of City Hall. ATE also has six (fl other properites that have received grant approval concern- ing the design stage of new facilities. Staff contacts with properties managed by ATE have brought many positive state- ments by the cities contacted. These contacts have definitely impressed the committee as to explaining why ATE is the only transit management firm that is steadily increasing the number of properties they manage.
