q RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Application
for Project Grant Under Title III of the Older Americans Act and a Notification
of Contract Award and Contract Agreement, attached herewith which shall be
spread upon the minutes of the Council and as spread upon the minutes of this
Council shall constitute and be a part of this Resolution as if fully copied
herein in detail.
Passed by the City Council this 10th day of May ,1979.

TERMS AND CONDITIONS: It is understood and agreed by the undersigned that: 1) funds granted
as a result of this request are to be expended for the purposes set forth herein and in
accordance with all applicable laws, regulations, policies, and procedures of this State and
the Administration on Aging of the U. S. Department of Health, Education, and Welfare; 2) any
proposed change in the proposal as approved will be submitted in writing by the applicant
and upon notification of approval by the Area Agency on Aging shall be deemed incorporated
into and become a part of this agreement; 3) the attached Assurance of Compliance (Form AoA-
441) with the Department of Health, Education, and Welfare Regulations issued pursuant to
Title VI of the Civil Rights Act of 1964 applies to this proposal as approved; and 4) funds
awarded by the Area Agency may be terminated at any time for violations of any terms and
requirements of this agreement.

ASSURANCE OF COMPLIANCE WITH THE DEPARTM NIT OF
HEALTH, EDUCATION, AND WELFARE REGULATION UNDER
TITLE VI OF THE CIVIL RIGHTS ACT OF 1964

after called the "Subgrantee") HEREBY AGREES THAT it will comply
with Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and
all requirements imposed by or pursuant to the Regulation of the
Department of Health, Education, and Welfare (45 CFR Part 80)
issued pursuant to that title, to the end that, in accordance
with Title VI of that Act and the Regulation, no person in the
United States shall, on the ground of race, color, or national
origin, be excluded from participation in, be denied the benefits
of, or be otherwise subjected to discrimination under any program
or activity for which the Subgrantee receives Federal financial

the Subgrantee, or in the case of any transfer of such property,
any transferee, for the period during which -the real property
'or structure is used for a purpose for which the Federal financial
assistance is extended or for another purpose involving the pro-
vision of similar services or benefits. If any personal -property
is so provided, this assurance shall obligate the Subgrantee for
the period during which it retains ownership or possession of
the property. In all other cases, this assurance shall obligate
the Subgrantee for the period during which the Federal financial
assistance is extended to it by the Grantor.

THIS ASSURANCE is given in consideration of and for the purpose
of obtaining any and all Federal grants, loans, contracts,
property, discounts or other Federal financial assistance'ex-
tended after the date hereof to the Subgrantee by the Grantor,
including installment payments after such date on account of
applications for Federal financial assistance which were approved
before such date. The Subgrantee recognizes and agrees that
such Federal financial assistance will be extended in reliance
on the representations and agreements made in this assurance,
and that the Grantor or the United States or both shall have
the right to seek judicial enforcement of this assurance. This
assurance is binding on the Subgrantee, its successors, trans-
ferees, and assignees, and the person or persons whose signatures
appear below are authorized to sign this assurance on behalf of
the Subgrantee.

NOTIFICATION OF CONTRACT AWARD & CONTRACT AGREEMENT
TITLE III
THIS AGREEMENT, entered into as of this 1st day of March , 1979
by and between Office on Aging, South Plains Association of Governments of the City/
County of Lubbock/Lubbock , State of Texas hereinafter
referred to as the "Agency", and City of Lubbock of the City/
County of Lubbock/Lubbock , State of Texas
hereinafter referred to as the "Contractor". WITNESSETH THAT:
The Agency and the Contractor do mutually agree as follows:
1. The Contractor shall, in a satisfactory and proper manner as determined
by the Agency, perform the following:

The Agency shall furnish the following services, data and information to
the Contractor:

2. The Contractor shall commence performance of this Contract on the 1St
day of March , 1979 , and shall complete performance to the satisfac-
tion of the Agency no later than the 29th day -of February , 19$0
3. It is understood that accountability for equipment purchased with federal
funds from this contract remains the responsibility of the appropriate
agency administering those funds and any disposition of such equipment must
be according to established federal government procedures.
The Contractor shall maintain such records and accounts including property,
personnel, and financial records, as are deemed necessary by the grantee
to assure a proper accounting for all project funds, both Federal and non -
Federal shares. These records will be made available for audit purposes
to the grantee or the Governor's Committee on Aging, and will be retained
for five years after the expiration of this contract unless permission to
destroy them is granted by both the grantee agency and the Governor's
Office. These records will be maintained at the following location:

2. Increase present volunteer strength of 50 to at least 200 by end
of contract year.
3. Through the Volunteer Center operate an Information and Referral
Counseling Program, including the Mayor's Telephone Reassurance
Program.
4. Seek state funds from the Governor's Committee on Aging for the
project beginning March 1, 1979.
5. Participate in all training events and region -wide activities
sponsored by Area Agency on Aging.
6. Maintain and submit necessary forms and reports.
7. Maintain confidentiality of each participant.
8. Comply with Title VI, Civil Rights Act of 1964.
9. Provide outreach to develop minority and low income as well as other
volunteers.
10. Provide matching funds as described in contract application.
