Campbell - SW 1/4 Sec 11 Block E2 - 04/26/1979J!VV:hw RESO. #148 - 4/26/79 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Contract of Sale of Land between said City (as Vendee) and Frank S. Campbell, Trustee, as Vendor, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Agent TIED TO RESO. #148 - 4/26/79 CONTRACT FOR SALE OF LAND THE STATE OF TEXAS § COUNTY OF LUBBOCK , § This contract of bargain and sale, made and entered into this the 26th day of April, 1979, by and between FRANK S. CAMPBELL, Trustee, called Vendor, and CITY OF LUBBOCK, a Home Rule Municipality of Lubbock County, Texas, called Vendee, witnesseth: (1) That the said Vendor has this day bargained and sold and by these presents does hereby bargain, sell and obligate himself to convey or cause to be conveyed in manner as hereinafter stated unto the said Vendee all and singular the following described property, to -wit: BEGINNING at a point which is the Southeast corner of the South- west quarter of Section 11, Block E-2, Lubbock County, Texas; THENCE S 89°59'40" W a distance of 350.00 feet; THENCE N 00°01'10 E a distance of 650.00 feet; THENCE N 89059'40" E a distance of 350.00 feet to the east line of the Southwest quarter of Section 11, Block E-2; THENCE'S 00001110" W a distance of 650.00 to the POINT OF BEGINNING. Contains 5.22 acres. (2) The consideration paid and to be paid to Vendor herein by said Vendee for the property above described is the agreed sum of THIRTY EIGHT THOUSAND THREE HUNDRED SIXTY-THREE AND N0/100 ($38,363.00) DOLLARS, to be paid as follows: Entire amount of $38.363.00 shall be paid by Vendee to Vendor upon closing and delivery to Vendee of a Warranty Deed conveying good and merchantable title to the real estate above-described. (3) Vendor, at his expense,- shall furnish an owner's title policy in amount of the purchase price containing no exceptions for title except the usual exceptions customarily contained in such policies on Texas form of title policy. (4) This contract of sale shall be consummated on or before 30 days from date hereof. (5) Taxes shall be prorated to date of closing of this contract of sale. (6) In the event of failure good and merchantable title, Vendee may declare this contract null and void, or Vendee at its option may waive title defects and enforce specific performance of this contract, or Vendee may en- force specific performance of same -in event Vendor shall fail or refuse to consummate the sale. (7) Consideration of this contract is the mutual performance hereof of the covenants hereby agreed to be performed by the parties hereto.
