RESOLUTION
RESOLUTION #321 - 10/25/79
WHEREAS the City Council of the City of Lubbock finds it in the public
interest to accept a Grant and authorize the Mayor to execute certain forms
with respect to such Grant in relation to a Water.Reclamation Plant, Step 2,
NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
1. THAT the City of Lubbock does hereby accept a Grant for a Step 2
Project, being preparation of facilities plans and specifications for con-
struction of primary and secondary digesters at the Southeast Reclamation Plant
from the Environmental Protection Agency of the United States Government
acting also through the Texas Department of Water Resources, said offer of
Grant being made by the Environmental Protection Agency in a letter addressed
to the Mayor of the City of Lubbock, dated October 5, 1979, and the Mayor is
hereby authorized and directed to execute Grant Acceptance Forms in connection
with said Project to be delivered to the Texas Department of Water Resources
and/or the Environmental Protection Agency.

PART III - GRANT CONDITIONS
a. General Conditions:
The grantee covenants and agrees that it will expeditiously initiate and timely complete the project
assistance has been awarded under this grant, in accordance with all applicable provisions of 40 CF]
B. The grantee warrants, represents, and agrees that it, and its contractors, subcontractors, employ
will comply with: (1) all applicable provisions of 40 CFR Chapter 1, Subchapter B, INCLUDING B
TO the provisions of Appendix A to 40 CFR Part 30, and (2) any special conditions set forth in thi
any grant amendment pursuant to 40 CFR 30.425.
b. Special Conditions:
1. Payment Schedule
Payment may be requested for the Federal share of allowable costs
incurred. Payments should be submitted in accordance with the
following schedule.

2. The grantee agrees to submit to the Environmental Protection
an approvable User Charge System and Industrial Cost Recovery Sysl
as required by 40 CFR 35.935-13 and 35.935-15 of Federal Register
Vol 43, No. 188, dated September 27, 1978.
3. The grantee agrees to take affirmative actions toward accomp'
the Region 6 MBE policy, EPA national policy published in Federal
Register, Volume 43, No. 248, dated December 26, 1978, and 40 CFR
35.936-7. No Federal payments will be released until documentatit
of the positive efforts taken toward reaching this goal has been
received and approved by EPA.
4. The grantee agrees to comply with the public participation pi
regulations 40 CFR 25 and 40 CFR 35.917-5 as published in Federal
Register, Vol. 44, No. 34, Part V and Part VI, dated February 18,

PART IV
NOTE: The Grant Agreement must be completed in duplicate and the Original returned to the Grants Administration
Division for Headquarters grant awards and to the appropriate Grants Administration Office for state and local awards
within 3 calendar weeks after receipt or within any extension of time as may be granted by EPA.
Receipt of a written refusal or failure to return the properly executed document within the prescribed time, may result
in the automatic withdrawal of the grant offer by the Agency. Any change to the Grant Agreement by the grantee sub-
sequent to the document being signed by the EPA Grant Award Official which the Grant Award Official determines to
materially alter the Grant Agreement shall void the Grant Agreement.
OFFER AND ACCEPTANCE
The United States of America, acting by and through the U.S. Environmental Protection Agency (EPA), hereby offers
a grant/amendment to the Ci ty of Lubbock for 85 % of all approved costs incurred up to and not
