RESOLUTION
A RESOLUTION OF THE CITY OF LUBBOCK, TEXAS, SUSPENDING THE OPERATION OF PROPOSED
RATE SCHEDULES FILED BY SOUTH PLAINS ELECTRIC COOPERATIVE, INC., FOR A PERIOD
OF 120 DAYS BEYOND THE DATE ON WHICH SUCH SCHEDULES WOULD OTHERWISE GO INTO
EFFECT.
WHEREAS, the South Plains Electric Cooperative, Inc., did on the 23rd day
of November, 1979, file a schedule of rates for electric utility service
within the City of Lubbock, Texas, to become effective January 1, 1980; and
WHEREAS, under the provisions of Vernon's Ann.Civ.St., art. 1446c, the
City Council as the governing body of the City of Lubbock, Texas, is the Regu-
latory Authority having primary jurisdiction as to electric utility rates
within the corporate limits of the City of Lubbock, Texas; and,
WHEREAS, after hearing all presentations made in open meeting as to the
subject matter of this Resolution, it is the opinion of the City Council of
the City of Lubbock, Texas, as the Regulatory Authority, that such schedules
of rates should be suspended for a period of 120 days from January 1, 1980,
for further study, investigation, presentation of evidence, and public hearing;
and,
WHEREAS, a copy of this Resolution and the considered reasons for suspensio
of such schedules of rates have been provided to South Plains Electric Cooperati ,
Inc., prior to the consideration of this Resolution by the City Council of the
City of Lubbock, Texas; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS:
Pursuant to Section 43(d) of the Public Utilities Regulatory Act of the
State of Texas, the operation of the proposed rate schedules filed with the
City of Lubbock on the 23rd day of November, 1979, by the South Plains Electric
Cooperative, Inc., is hereby suspended for a period of 120 days from the 1st
day of January, 1980, for further study, investigation, presentation of evidence,
and public hearing.
ADOPTED by the City Council of the City of Lubbock, Texas, this the 20th
day of December, 1979.

Please take notice that the City Council.of the City of Lubbock, Texas,
sitting as the Regulatory Authority in reference to the Rate Application filed
on or about the 23rd day of November, 1979, in special session on the 20th day
of December, 1979, took the following actions:
1. Passed Resolution No. 372, a certified copy of which is attached
hereto, suspending the operation of the proposed rate schedules filed by South
Plains Electric Cooperative, Inc., for a period of 120 days beyond the date on
which such schedules would otherwise go into effect; and,
2. Passed Resolution No. 373, a certified copy of which is attached
hereto, setting public hearing upon the Rate Application filed by South Plains
Electric Cooperative, Inc., for 2:00 o'clock P.M., on Thursday the 24th day of
January, 1980, in Council Chambers on the second floor of the Municipal Building,
in the City of Lubbock, Lubbock County, Texas.
Please take notice of both such actions. In relation to the public hearing
the City Council was informed by the counsel that the date of hearing was set
to conform with the requirements of the Public Utility Regulatory Act of the
State of Texas, but that.due to conflicting scheduling before the Public Utility
Commission a continuance from the hearing date set to a more appropriate date
would probably -be subsequently required.
