Frazier Company, and to execute for and on behalf of the City of Lubbock, a construction contract with same R.L. Frazier Company, in the amount of $362,543.00 subject to prior execution by the contractor and final approval by the City Attorney. Said contract is attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. CONTRACT STATE OF TEXAS X X COUNTY OF LUBBOCK X RESOLUTION 4371 - 12/12/79 Bid #5574 THIS AGREEMENT, made and entered into this 12th day of December A.D., 1979, by and between the City of Lubbock, of the County of Lubbock, and State of Texas, acting through Dirk West, Mayor thereunto duly authorized so to do, Party of the First Part, hereinafter termed Owner, and R. L. Frazier Company of the City of Lubbock , County of Lubbock and State of Texas , Party of the Second Part, hereinafter termed Contractor WITNESSETH: That for and in consideration of the payments and agree- ments hereinafter mentioned, to be made and performed by the Party of the First Part•(Owner), and under the conditions expressed in the bonds bearing even date herewith, the said Party of the Second Part (Contractor), hereby agrees with said Party of the First Part (Owner), to commence and complete the construction of certain improvements described as follows: The construction of a new transformer vault, installation of transformer vault equipment, installation of standby engine -generator, installation of airport rotating beacon, installing new lighting cable, installing duct, construc- tion of manholes, and other related items of work, all as shown on the plans entitled, "City of Lubbock, Texas, Lubbock International Airport, Transformer Vault and Beacon Construction," dated September, 1979 and the specifications attached hereto. This contract shall include all extra work in connection, therewith, under the terms as stated in the General Conditions of the Agreement; and at his (or their) own proper cost and expense to furnish all the materials, supplies, machinery, equipment, tools superintendence, labor, insurance, and other accessories and services necessary to complete the said construction, in accordance with the conditions and prices stated in the Proposal attached hereto, and in accordance with all the General Conditions of the Agreement, and in accordance with the Plans, which includes all maps, plats, blueprints and other drawings and printed or written explanatory matter thereof, and the Specifications therefor, as prepared by Parkhill, Smith & Cooper, Inc., Consulting Engineers, Lubbock, E1 Paso, and Midland, Texas, herein entitled the Engineer, each of which has been identified by the endorsement of the D-1 Contractor and the Engineer thereon, together with the Contractor's written Proposal, the General Conditions of the Agreement, and the Performance Bond and Payment Bond hereto attached; all of which are made a part hereof and collectively evidence and constitute the entire contract. The Contractor hereby agrees to commence work under this contract on or before a date to be specified in a written "Notice to Proceed" of the Owner and to fully complete the project with 180 consecutive calendar days thereafter. The Contractor further agrees to pay, as liquidated damages, the sum of $50 for each consecutive calendar day thereafter as hereinafter provided in Paragraph 32 of the General Conditions. The Owner agrees to pay the Contractor in current funds for the per- formance of the contract in accordance with the Proposal submitted therefor, subject to additions and deductions, as provided in the specifications, and to make payments on account thereof as provided therein.
