City Atto ey THE STATE OF TEXAS x COUNTY QF TRAVIS x -RESOLUTION #396 - 1/24/80 Contract Number RSVP - 31 RETIRED SENIOR VOLUNTEER PROGRAM THIS CONTRACT AND AGREEMENT is entered into by and between the Governor's Committee on Aging, hereinafter referred to as GCA. State of Texas and City of Lubbock for the use of State funds appropriated under Senate Bill No. 843 of the 66th Legislature to earn Federal funds through ACTION grants under authority of Public Law 93-113 applicable to Retired Senior Volunteer Programs. I. STATEMENT OF SERVICES TO BE PERFORMED: All funds spent under this contract are subject to the terms and conditions of any and all ACTION grants under the aforemen- tioned authority for the period beginning September 1. 1979 and ending August 31, 1980. 11. BASIS FOR CALCULATING REIMBURSABLE COSTS: A grant of $ 5,351.33 is authorized to be used in accordance with the terms and conditions of ACTION Grant No. RSVP - 31 and any subsequent grants entered into between ACTION and City of Lubbock during fiscal year 1980. 111. CONTRACT AMOUNT: The total amount of this Contract shall not exceed $ 5,351.33 IV. PAYMENT FOR SERVICES: Payments for service performed shall be billed quarterly. V. TERMS OF CONTRACT: The contractor must submit its ACTION quarterly report of activities to GCA in a timely manner. Financial and program records shall be available to GCA for Fiscal and Program audit purposes. The undersigned parties do bind themselves to the faithful performance of this Contract. It is mutually understood that this contract shall not become effective until signed by both parties and that no payments under the terms of this Contract will be made until one (1) signed copy is returned to the Governor's Committee on Aging. St. Paul, Suite 1600, Dallas, Texas 75201 and the City of Lubbock, Lubbock, Texas 79457. The purpose of this agreement is to set forth the parties' understanding con- cerning the establishment and operation of a Retired Senior Volunteer Program, pursuant to Sections 201, 402 (12) and (14) of the Domestic Volunteer Services Act of 1973 as amended (P.L. 93-113), to be funded and sponsored by the City of Lubbock (Project Sponsor). This agreement is in effect for the period 01-01-80 through 12-31-80 . I. Project Sponsor A. The City of Lubbock is the RSVP Sponsor and is responsible for the daily operation of the project. B. The sponsor will operate the project without ACTION federal grant funds during the project period, 01-01-80 _through 12-31-80 C. The Sponsor agrees to: 1. Establish and operate an RSVP project in accordance with the following legislative provisions, regulations and program guide- l ines: a. Provisions of the Domestic Volunteer Service Act of 1973, as amended (P.L. 93-113). b. Retired Senior Volunteer Program Regulations (Title 45, Code of Federal Regulations, Part 1209, December 7, 1976) except Subpart B, Section 1209.2-3, 1209.2-5, 1209.2-6, 1209.2-7. Subpart D. c. Title VI, Civil Rights Act of 1964 (P.L. 88-352) is required. d. Other federal laws, regulations and policies which are or be- come applicable to the RSVP program. RSVP Operations Handbook) is recommended. 3. Prepare the following forms: a. Project Narrative and Continuation Narrative (ACTION Form A-5 b. Quarterly Reports c. The RSVP Operations Handbook (Order 4405.92) Chapters l through 7, including, but not limited to, the following yam; policies: (1) The project shall have its own separate project. director. (2) There shall be a separate project advisory council for the project. (3) Service requirements for volunteers in church re- lated organizations or activities identified in the program operations handbook must be followed. f. Any subsequent changes or modifications in a --c. 2. Comply with the following special conditions: a. Volunteers shall not serve in volunteer stations where identical ACTION -funded OAVP volunteers are serving. b. The project shall maintain separate records -for the pur- poses of fiscal accountability. '`.. c. Monitoring, or management reviews, will be conducted by ACTION to ascertain that program policies, plans and pro- cedures are being followed, and to protect program identity. " d. ACTION will not conduct fiscal audits. However, copies of reports of fiscal audits conducted by or for.the sponsor shall be transmitted to the ACTION State Program Director. e. Termination and suspension procedures identified in the pro- gram operations handbook are applicable when there is a material failure to comply with terms and conditions of this a� Agreement. f. Adherence to ACTION volunteer project cost policies for in- surance, transportation and meals (Section 33b(2) of the RSVP Operations Handbook) is recommended. 3. Prepare the following forms: a. ACTION A. ACTION will provide: 1. Technical guidance and materials in connection with the establishment, development and management of a Retired Senior Volunteer Program. 2. Volunteer recognition materials, including available pins and certificates, for appropriate use with volunteers in the pro- ject. 3.
