RESOLUTION #452 - 3/27/80
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock an Agreement with
the Lubbock Independent School District regarding swimming facilities for Title
I Program, copy attached herewith which shall be spread upon the minutes of the
Council and as spread upon the minutes of this Council shall constitute and be
a part of this Resolution as if fully copied herein in detail.

Agreement made this 27th day of March , 1980, by and
between the City of Lubbock, hereinafter referred to as City, and the Lubbock
Independent School District, hereinafter referred to as L.I.S.D.
I.
WHEREAS, it is to the mutual benefit of the City and L.I.S.D. to make use
of the swimming facilities of the City to provide for the waterproofing of the
Title I children of Lubbock, Texas, WITNESSETH:

In consideration of the covenants hereinafter set forth, the City agrees
to provide swimming facilities, on an availability basis, to L.I.S.D. for the
limited purpose of waterproofing the intermediate students in the Title I
Summer Program. The City further agrees to make available water safety per-
sonnel during the hours of operation of the swimming program contemplated by
this agreement.
L.I.S.D. hereby agrees to pay to the City from currently available revenues,
the amount of $0.35 per participating student per visit to a City pool under
the terms of this agreement. Such payment is to be made at the expiration of
this agreement.
This sum is not to exceed a total of $2,800.00 with the L.I.S.D. respons-
ible for monitoring the program so that its obligation to the City shall not
exceed this sum at the expiration of this agreement.
L.I.S.D. further agrees to provide supervisory personnel for the purpose
of maintaining discipline among the participating students.
IV.
The term of this agreement shall commence on June 10, 1980, and terminate
on July 2, 1980, for designated hours only.
V.
It is expressly agreed that there shall be no liability for any failure
of the City to provide the services agreed on due to unavailability of personnel
or facilities.
IN WITNESS WHEREOF, the City and L.I.S.D. have executed the agreement as
of the date first above written.
