J► -0^T TimTn*T RESOLUTION #438 - 3/13/80 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and . directed to execute for and on behalf of the City of Lubbock an agreement with the Lubbock Cultural Affairs Council to provide a $5,000 grant for the pre- paration of a feasibility study regarding the conversion of a building to a cultural affairs center attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. Tom, Assistant City Attorney RESOLUTION 438 - 3/13/80 STATE OF TEXAS § COUNTY OF LUBBOCK § AGREEMENT This agreement between the City of Lubbock, a Municipal Corporation, hereinafter referred to as City, and the Lubbock Cultural Affairs Council, a Texas non-profit corporation, hereinafter referred to as Council, WITNESSETH: WHEREAS, Article 1269]-4.1 Vernon's Texas Civil Statutes, authorizes the City to levy by Ordinance a hotel occupancy tax which may not exceed four percent of the consideration by a hotel occupant; and WHEREAS, Article 1269]-4.1 Vernon's Texas Civil Statutes, authorizes the City to utilize revenues derived from the aforementioned tax for the encourage- ment, promotion, improvement, and application of the arts, including music, dance, drama, folk art, creative writing, architecture, design and allied fields, painting, sculpture, photography, graphic and craft arts, motion Pictures, television, radio, tape and sound recordings, and the arts related to the presentation, performance, execution and exhibition of these major art forms, and WHEREAS, Council is engaged in the promotion and support of the afore- mentioned art forms in the City of Lubbock, and WHEREAS, the City is desirous of encouraging projects which will allow the local citizenry to have an opportunity to avail themselves of many of the art forms hereinabove mentioned; NOW THEREFORE, the City and Council do hereby agree as follows: I. Council will contract for the services of an architectural consultant for the purpose of preparing a feasibility study on the conversion of the former "Sears" Building located at 1625 13th Street, Lubbock, Texas, to a Cultural Affairs Center. Performance of said contract is to be completed by September 30, 1980. II. The City does hereby agree to appropriate monies derived from the hotel occupancy tax authorized under Article 1269]-4.1 Vernon's Texas Civil Statutes, up to the amount of $5,000.00. Said monies to be used by Council to cover the costs entailed in the feasibility study. Any surplus shall be reimbursed to the City. After the Council has executed a contract with an architectural consultant to perform the study contemplated herein, it may bill the City who will pay the required fee upon receipt of a statement. IV. The City reserves the right to examine the Council's financial records which relate to this project in order to verify the expenditures. No audit is required. V. Council shall provide the City with a final copy of the feasibility study report. Executed this 13th day of March 1980.
