RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Change Order
No. 2 to a contract with Kerr Construction Company for Terminal Parking
and Roadway Improvements at the Lubbock International Airport, providing
a time extension for completion, a copy of which is attached herewith which
shall be spread upon the minutes of the Council and as spread upon the minutes'
of this Council shall constitute and be a part of this Resolution as if fully
copied herein in detail.

General description of work included in contract:
The construction of 8,700 square yards of flexible pavement on entrance and
service roads to the terminal building, construction of approximately 6,850 square
yards of flexible pavement in the terminal parking area and access roads, construc-
tion of approximately 5,800 square yards of flexible pavement in the employee park-
ing area, construction of approximately 9,000 linear feet of curb and gutter on the
entrance roads and terminal parking area, relocation of existing and, construction
of new area lighting on the entrance roads, and parking areas, relocation of exist-
ing and construction of new security fencing, relocation of existing and installa-
tion of new parking control equipment, construction of an irrigation system, con-
struction of drainage structures and concrete slabs, removal of existing pavement
and curb and gutter, painting of roads and parking areas, and other related items'
of work. Additive Alternate Number One to the contract consists of installing a
parking lot counter system to monitor available parking spaces and automatically
control lot full indicators and entrance gate operation. Additive Alternate Num-
ber Two to the project consists of the construction of approximately 5,200 square
yards of flexible pavement in the terminal parking area, construction of approxi-
mately 1,150 linear feet of curb and gutter, construction of area lighting, con-
struction of concrete slabs, painting of parking areas and miscellaneous items of
construction.

WHEREAS, during the construction time provided by the contract for the pro-
ject, work was delayed due to coordination with other contractors during construc-
tion of the auto parking structure;
AND WHEREAS, during the construction of the project, work was delayed for the
proper season for planting grass on the project;
AND WHEREAS, during the construction time provided by the contract for the pro-
ject, work was delayed due to weather conditions such as rain and snow during cri-
tical periods of work;
THIS AGREEMENT WITNESSETH: In consideration of the mutual advantage gained,
the Owner and Contractor agree that the time allowed for completion of the project
shall be extended 357 days, from 360 days to 717 days, and further agree that there
shall not be any adjustment to the contract price for the extension of time.
IN WITNESS WHEREOF, the Owner and the Contractor have hereto set their hands
this the 14th day of August , 1980.

Dear Mr. Coffee:
Transmitted herewith are seven (7) copies of Change Order No. 2
for the referenced project. This is for a time extension for
completion of the project. The Contractor, Kerr Construction
Company, has requested an extension of time for the various rea-
sons stated in their letter, a copy of which is attached, and in
Change Order No. 2.
We recommend approval of Change Order No. 2.
After Change Order No. 2 has been fully executed, please return
four (4) copies to this office for distribution.

Gentlemen:
In accordance with Paragraph GC -32 in the General Conditions
of the Agreement which accompany the contract documents for
the above captioned project, we hereby submit a request for
an extension of the completion date to August 1, 1980.
When you were preparing the plans and specifications for
this project, we were consulted about various details to
be involved in the construction, including proposed contract
time. We in our perennial optimism agreed that the contract
time specified appeared to be adequate for the work to be
done. We were wrong.
Several specific time-consuming delays occurred during the
construction work, although we began our work as soon as we
were issued a notice to proceed:
(1) In addition to completing the terminal access road
east of the new parking building, we had to complete
Entrance No. 1 at the northeast corner of the old
parking lot, with gates fully operational, before we
could obliterate the old terminal entrance road.
Construction of Entrance No. 1 could not be started
until traffic was placed on the new terminal access
road, because of the requirement that traffic access
be maintained to the terminal building and parking lot
at all times; also, we had to keep at least two long
term entrance gates operational at all times. The
rains and ice which we received in Fall 1978 inter-
fered considerably with our accomplishing this sequence
of events which had to be completed before we could
obliterate the old terminal entrance road at the east
side of the old parking lot.

(2) While this rather lengthy sequence of events listed
in paragraph (1) was being done as rapidly as possible,
we prepared the subgrade for the east half of the new
parking building, allowing the building contractor to
get started on that half while waiting on our obliter-
ation of the old terminal entrance road, which had to
be done before we could prepare his subgrade for the
west half of the parking building.
(3) From this point (obliteration of the old terminal
access road), we were working with and around the
building contractor, who had his share of delays
(strikes, weather, etc.) We completed the parking
entrance road several weeks prior to opening of the
parking structure.
(4) Unforeseen problems with the installation of the
parking control equipment (principal problem: re-
tirement of Bob Eakin) delayed completion of this
installation, including the lot counter system,
which is apparently the first such system in West
Texas.
(5) The seeding period for the last sections requiring
grass began May 15, 1980. Some weather delays have
occurred, and a principal unforeseen delay was the
sprinkler contractor's difficulty in checking out
his new system because of faulty control valves in
the City's old system. Many of these old valves are
still not functioning properly, but the grass sub-
contractor has been working some valves manually to
get his grass started.
We began this project as soon as we were given the notice
to proceed, and have prosecuted the work regularly, diligently,
and uninterruptedly, and although we feel sheepish about our
earlier optimism concerning completion time, we feel that the
project has been pursued with necessary diligence from start
to finish.
We will appreciate your favorable consideration of this
request that the completion date be extended to August 1,
1980.
