WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine the public
needs, safety, health and welfare demands and creates a public necessity for
the constructing, reconstructing, and expansion and improvement of the airport
facilities and runways of said City for the improvement of aviation transporta
tion into and out from said City creating a need for additional land by said
City to accomplish such purposes and this City Council of said City finds it to
the best public interest and for public purposes and municipal purposes to
proceed with the acquisition of lands as needed for such purposes as aforesaid;,,
NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the following described real
estate located in Lubbock County, Texas, be acquired for public purposes and
municipal purposes as set forth in the preamble hereof, to -wit:
A tract of land out of Section 43, Block A, H.E. & W.T. R.R. Co.
Survey, Lubbock County, Texas, and being more particularly described as follows;
BEGINNING at a found 3/8" iron rod, the Northwest corner of Section 43,
Block A, for the Northwest and beginning corner of this tract;
THENCE South along the West line of Section 43, Block A, 120.19 feet to a
point, for a corner of this tract;
THENCE East, 30.0 feet to a point, the P.C. of a curve to the left and a
corner of this tract;
THENCE Southeasterly along the arc of a curve to the left, an arc distance,
of 156.84 feet to the P.T. of said curve, and a corner of this tract; said
curve having a radius of 199.7 feet, a central angle of 45°00'00" and a
chord that bears South 22°30'00" East, 152.84 feet;
THENCE South 45'00" East, 404.53 feet to a point, for a corner of this
tract;
THENCE East 1458.46 feet to a point, for a corner of this tract;
THENCE South, 900.0 feet to a point, for a corner of this tract;
THENCE West, 1458.46 feet to a point, for a corner of this tract;
THENCE South 45000'00" West, 404.53 feet to the P.C. of a curve to the
left, and a corner of this tract;
THENCE Southwesterly along the arc of a curve to the left, an arc distance
of 156.84 feet to the P.T. of said curve and a corner of this tract, said
curve has a radius of 199.7 feet, a central angle of 45°00'00" and a chord
that bears South 22030'00" West, 152.84 feet;
THENCE West, 30.0 feet to a point in the West line of Section 43, Block A,
for a corner of this tract;
THENCE south along the West line of Section 43, 72.74 feet to a railroad
spike set for the Southwest corner of this tract;
THENCE South 89°56'00" East at 5240.00 feet pass a 3/8" iron rod, contin-
uing for a total distance of 5280.0 feet to a 3/8" iron rod set in the
East line of Section 43, Block A, for the Southeast corner of this tract;
THENCE North along the East line of Section 43, Block A, 1953.6 feet to a
1/2" iron pipe, found for the Northeast corner of Section 43, and the
Northeast corner of this tract;
THENCE West along the North line of Section 43, Block A, 5280.0 feet to
the PLACE OF BEGINNING.

SECTION 2. THAT the owners of said land including Lois Cone Bates and
Betty Lour Petree, Trustees and Marie Louise Abell Butler also known as Mary
Louise Abell Butler and Mercantile - Safe Deposit & Trust Company, Trustees fort
the Estate of Arunah S. Abell, III and heirs of Arunah S. Abell III. BE offered
through the Right -of -Way Department of the City of Lubbock the amount of
$262,497.00, which is the amount appraised as the value and total damages for
the fee simple title and acquisition of said real estate hereinabove described
for the purposes herein stated, for the use and benefit of the City of Lubbock,!
located in Lubbock County, Texas, and unless accepted forthwith the City
Attorney of said City of Lubbock is hereby authorized and instructed to institute
condemnation (eminent domain) proceedings to acquire the fee simple title to
said land as hereinabove described for public purposes and municipal purposes.
