ART. 1446c, AND AS THE CITY COUNCIL OF THE CITY OF LUBBOCK WITH REGARD TO ELECTRIC RATES CHARGED BY SOUTHWESTERN PUBLIC SERVICE COMPANY AND LUBBOCK POWER AND LIGHT AND WATER, RESPECTIVELY AFFIRMING PRIOR TARIFFS WHICH WERE UNCHANGED BY THE ACTION OF THIS' AUTHORITY AND COUNCIL TAKEN AT ITS JULY 10, 1980 MEETING. WHEREAS, the City Council of the City of Lubbock established new electric rates for Southwestern Public Service Company and Lubbock Power and Light and water by an Order and Resolution entered the 10th day of July, 1980; and, WHEREAS, the tariffs attached hereto were unchangedby the action of the City Council above referred to; and WHEREAS, the City Council deems it appropriate to reaffirm the unchanged rates for purposes of clarity so that only those rates as approved by Council action of July 10, 1980, may be increased; NOW THEREFORE: BE IT ORDERED AND RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the tariffs attached hereto remained unchanged and shall remain in effect both as to Southwestern Public Service Company and Lubbock Power and Light and Water, and that only those tariffs as approved by Council action of July 10, 1980 may be increased in accord with the Order and Resolution hereto- fore entered. A_C_ 024 FTXCTRTC HEATING SERVICE TARIFF NUMBER 1503.7 CANCELLING 1503.6 APPLICABLE: .To residential and commercial customers for water heating and/or space heating service, including resistance heating, radiant heating and heat pumps, when all heating service is supplied at one point of delivery and measured through one kilowatt hour meter, which meter must be separate from the meter which measures the energy for lighting and general use. TERRITORY: Lubbock, Texas WATER HEATING RATE: All kwh used per month @ 1.15 per kwh SPACE HEATING RATE: Winter Months: All kwh used per month @ 1.15 per kwh Summer Months: Ail kwh used per month shall be combined and billed under the applicable residential or commercial rate, except that the first 500 kwh used per month through the heating meter will be billed @ 1.15 per kwh when cus- tomer has an electric water heater installed and in use. Space heating equipment and the installation of the equipment shall be subject to the approval of the supplying utility. To be eligible for the 1.15 cent space heating rate, a customer must have permanent- ly installed and in regular use space heating equipment having a total con- nected load of not less than 5 kilowatts. CHARACTER OF SERVICE: The voltage and characteristics of equipment applied shall meet requirements of the supplying utility. FOR WIND PDW£R£D GENERATION TARIFF NUMBER CANCELLING APPLICABLE: Under contract to customers taking service under the Company's residential or -commercial rates for stanTby or supplemental power for experi- mental electric service for customer-ouned wind powered generation, where metering facilities will meter the flow of electrical energy from the Company to the customer only and where facilities of adequate capacity and voltage are adjacent to the premises to be served. - TERRITORY: Lubbock, Texas., RATE: Same as applicable rate schedule for customer's load class with modified minimum as stated below. FUEL COST ADJUSTMENT: Same as applicable rate schedule ENERGY PURCHASE: At the request of the rmstomer, the Company will separately meter the flow of energy from the customer to the Company and pay the customer in the form of a credit to his bill for service an amount equal to the energy received from the customer times the fuel cost adjustment for that billing month. Payment will be made by the Company annually within 15 days after the anniversary date of connection or within 15 days after contract termination for any purchase credit not previously credited to the customer's monthly billings. METERING: Meter shall be installed with detent to measure power inflow only. At the customer's request a separate meter shall be installed at the customer's expense to measure the flow of energy from the customer to the Company. MINIMUM: The monthly bill shall not be less than an amount equal to 2.1% times the cost of equipment and facilities installed to provide service to the customer. The first 500 kwh will be billed at 2.62 per kwh, the next 500 kwh at 1.15s,% per kwh, and all additional kwh at 2.62 per kwh. CONDITIONS AND REGULATIONS Water heating equipment served on this rate shall be of insulated storage type bearing the approval of the Underwriters`s Laboratories, Inc., and shall have a demand of not greater than 5.5 Kilowatts individual capacity. MINIMUM CHARGE $5.10 per Month. CONDITIONS AND REGULATIONS Space heating equipment and the installation of the equipment shall be subject to the approval of the supplying utility. To be eligible for the space heat- ing rate, a customer must have permanently installed and in regular use space heating equipment having a total connected load of not less than five kilowatts. For heat pump installations, the rated capacity shall be determined by adding the rated capacity of any auxilliary heating elements used in conjunction with the heat pump. - FUEL COST ADJUSTMENT The net charge per kilowatt hour shall be increased or decreased 0.0067 cents per kwh for each 0.5 cent increase or decrease, or major fraction thereof, in the cost of fuel delivered at LPL generating stations, above or below 21 cents per 1,000,000 BTU. Box 2000 Area Code806-763-9381 LUBBOCK, TEXAS 79457 RESIDENTIAL LIGHTING AND SPACE HEATING APPLICABLE To residential customers for electric service used for domestic purposes in private residences and separately metered individual apartments when all service is supplied at one point of delivery, and measured through one kilowatt hour meter, where facilities of adequate capacity and suitable voltage are adjacent to the premises to be served. Single phase motors not to exceed 10 horsepower, individual capacity, may be served under this rate. RATE Service Availability Charge: $5.10 per month, which includes 30 kwh per month. When customer has in regular use permanently installed space heating equipment of an aggregate rated capacity of 5 kilowatts or more, excluding bathroom heaters, billing during the winter months will be the first 500 kwh at the regular rate, and all additional kwh at 1.150 per kwh. When cus- tomer has water heating in combination with all -electric space heating, the first 500 kwh will be billed at the regular rate, and all additional kwh at 1.15 per kwh. In the summer (May through October) all kwh used per month shall be under the residential rate. MINIMUM CHARGE $5.10 per month. ELECTRIC SERVICE AGREEMENT EXPERIMENTAL WIND POWERED GENERATION STATE OF TEXAS Z COUNTY OF LUBBOCK X THIS AGREEMENT, is made this day of , 1979, by and between the Lubbock Power and Light , hereinafter referred to as LP&L, and hereinafter referred to as the Customer. WITNESSETH WHEREAS, the Customer has notified LP&L that he/she intends to install on his/her property for the purpose of generating electric energy for his/her own use; and WHEREAS, LP&L wishing to encourage innovation in the energy field, is willing to furnish standby electric service to the Customer when the alternate power source is not available for the Customer's wind powered generating facilities; NOW THEREFORE, the parties hereto, each in consideration of the agree- ment of the other contained herein, agree as follows: 1. LP&L will furnish electric service to the Customer at on a standby basis for periods when the alternate power source is not available to the Customer for the operation of his own electric generating facilities. 2. Lubbock Power and Light will credit the customer's monthly bill for all KWH delivered/supplied to LP&L, as determined by recorded data, at a rate equal to said month's fuel adjustment charge for Lubbock, Texas. In the event that accumulated credits to the customer for KWH delivered to LP&L exceed the billing to the customer by LPsL, a payment for the excess credits will be made by LP&L annually within fifteen (15) days after the anniversary date of connection or within fifteen (15) days of termination of this agreement. 3. Prior to installation, the Customer will submit to LP&L a diagram for the wind powered generators and all electrical protection devices showing the complete electrical circuit of same. The diagram will indicate, in the judgment of LP&L, that the wind system cannot deliver energy to the LP&L system if loss of LP&L voltage occurs to the wind system. The diagram will also indicate, in the judgment of LP&L, that the wind system cannot cause damage or shutdown of any portion of Lubbock Power S Light's system in the event of an occurrence or failure in the operation of the wind system. No modification is to be undertaken to the wind system in the diagrams without the express written approval of Lubbock Power and Light. 4. Upon completion of the facilities, the Customer will so notify LP&L, and LP&L will thereupon inspect the facilities for compliance with the diagrams and will test the operating characteristics of the facilities for assurance of safety for its employees and accuracy of its meter(s) before authorizing the operation of the facilities. 5. It will be the Customer's sole responsibility to maintain the wind system so as to guarantee the operation of the specific safety features which prevent energy from being delivered to LP&L's system during a power failure on Lubbock Power and Light's system and those safety features necessary to isolate the wind system from LP&L's system in the event of an electrical malfunction of the wind system. 6. LP&L may at any time install or modify any equipment as it deems necessary to protect -the safety of its employees or the accuracy of its meter(s) as a result of the operation of the facilities, and the Customer shall reimburse LP&L for the cost of such installation or modification upon receipt of a statement therefor from LPSL. 7. Due to the reduced return on investment for the facilities provided to serve the Customer and in order to protect LP&L's other customers from subsidizing the wind system, the rata LP&L will charge to Customer will equal the rate charged to other buildings of a similar size and nature with a modified minimum bill calculated to prevent any LP&L losses due to the providing of the electric service. The monthly bill to the customer before the credits under Paragraph 2 shall not be less than 2.1% times LP&L's installed equipment and facilities cost to serve the customer. 8. LP&L will install a detent on the watt-hour meter used to register the electrical energy provided to the customer in order to prevent reverse registration. 9. The Customer will pay LP&L's costs in installing and providing a watt-hour meter With a detent which will be used in register the elec- trical energy the Customer will provide to LPSL. 10. The Customer will at all times be in compliance with all rules and regulations of LP&L and with all rules, regulations and ordinances of the City of Lubbock. This specifically includes obtaining a zoning variance from the Zoning Board of Adjustment, if installation of the facilities would be in violation of zoning ordinances. 11. Authorized LP&L employees will have the right to enter upon the Customer's property at any reasonable time for the purpose of inspecting or servicing the facilities and making additional tests to ensure their con- tinued safe operation and the accuracy of its meter, but such inspections shall not relieve the Customer from his obligation to maintain the facilities in satisfactory operating condition. 12. The data gathered by LP&L through the use of LPEL's metering facilities will be available to all Customers as may be required by law. -2- 13. If, in the sole judgment of LPEL, the operation of the wind system is determined to be detrimental to LP&L's other customers, or its equipment or its operating procedures, LP&L may notify the Customer to disconnect the facilities from LP&L's system and in the event the Customer fails to immediately comply with such notice, LP&L may dis- continue service to the Customer until the facilities are disconnected. 14. The Customer will indemnify, protect and hold harmless LP&L, its officers, agents and employees against all claims, demand,loss, damage, cost, expense and liability resulting from injury to or death of.any person or damage to any property, arising out of or in any way connected with the performance of this agreement, including any claims, demands, loss, damage, expense and liability proximately caused or contributed to by the negligence, whether active or passive, of LP&L, excepting only that which may be caused by the sole negligence or willful misconduct of LP&L. 15. No assignment of this agreement or of any right accruing hereunder shall be made, in whole or in part, by Customer without the prior consent of LP&L. 16. This agreement shall become effective immediately upon the execution hereof and shall continue in effect until terminated (except as to paragraph 13 if applicable) by either party upon thirty (30) days written notice given to the other party. 1N WITNESS WHEREOF, LP&L and have executed this agreement as of the date first above written. Executed this day of ATTEST: CUSTOMER By Its 19 ATTEST: LUBBOCK POWER AND LIGHT By Its JUL.1 ^ 1980 DGV..pc RESO. #565 - 7/10/80 ORDER AND RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK, SITTING AS A REGULATORY AUTHORITY UNDER VERNON'S ANN.CIV.ST., ART. 1446c, AND AS THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS, AS TO A RATE INCREASE APPLICATION BY SOUTHWESTERN PUBLIC SERVICE COMPANY; AS TO THE RATES CHARGED BY LUBBOCK POWER AND LIGHT AND WATER; AND WITHDRAWAL OF AN ORDER OF SUSPENSION AS TO SOUTHWESTERN PUBLIC SERVICE COMPANY'S PROPOSED RATES. WHEREAS, Southwestern Public Service Company filed a Rate Application with the City of Lubbock on the 22nd day of May, 1980; and WHEREAS, the Regulatory Authority on the 12th day of June, 1980, by resolution, suspended the operation of such proposed rate schedules for a period of 120 days beyond the date on which such schedules would otherwise go into effect; and WHEREAS, the City of'Lubbock traditionally has considered the rates of Lubbock Power and Light and Water upon receipt of a rate request from Southwestern Public Service Company and vise versa; and WHEREAS, documentation supporting such rate schedules as required by law has been presented to the Regulatory Authority by both utilities; and WHEREAS, upon such documentation and recommendations of staff, no evidence has been presented to the Regulatory Authority that would indicate that such proposed rates would be unreasonable under Vernon's Ann.Civ.St., art. 1445c; and, WHEREAS, upon consideration of all matters and testimony properly before it, the Regulatory Authority at public hearing finds that no finding that such rates are unreasonable is appropriate, with the exception that as to Southwestern Public Service Company's proposed residential service rate, the figure of 0.0069 cents in the Fuel Adjustment paragraph be changed to read 0.0067 cents; and WHEREAS, the City Council deems it appropriate to withdraw the suspension of the operation of Southwestern Public Service Company's proposed rates which was entered the 12th day of June, 1980; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT pursuant to the provisions of Vernon's Ann.Civ.St., art. 1446c, the resolution of the City of Lubbock, Texas, dated the 12th day of June, 1980, which suspended operation of the Rate Application of Southwestern Public Service Company, as filed with City of Lubbock, Texas, on the 22nd day of May, 1980, for a period of 120 days from the date on which such schedules otherwise would have gone into effect, should be, and is hereby, withdrawn. THAT by this action Southwestern Public Service Company shall be entitled to place into effect such -proposed rates, attached hereto as Exhibit A with the exception that the figure of 0.0069 cents in the Fuel Adjustment paragraph for residential service rates is hereby ordered to be changed to 0.0067 cents prior to implementation of such rates, which may be done immediately upon completion of the ordered change hereinabove set out. THAT by this action Lubbock Power and Light and Water shall be entitled to place into effect the rates attached hereto as Exhibit B, which rates shall be effective at such time as Lubbock Power and bight and Water shall deem it appropriate and possible to implement such rates. It is now necessary for us to request a rate increase in the City of Lubbock. This letter will serve as an official Statement of Intent to increase the rates in Lubbock. The.enclosed packet contains information supporting the need for a rate increase and the propos- ed tariffs. Pursuant to the law (Article 1446C V.A.C.S.), we propose to make these rates effective for billings on and after June 26, 1980, 35 days from today. If the City takes no action within that time, the law considers the rates to be approved as filed. The proposed changes are expected to increase the operating revenue of Southwestern Public Service Company by 7.52%, or $2,808,756, in our Lubbock service area.
