RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and
directed to execute for and on behalf of the City of Lubbock a Statement of
Community Services Administration Grant in the amount of $176,200.00 for
funding of the Community Services Department of the City of Lubbock through
Region VI of the Community Services Administration.

SUBJECT: Special Conditions to Community Services Grant October 22, 1980
As was communicated to you in the agenda comments, the Community Services
Administration has approved our grant for the fiscal year beginning
October 1, 1980; however, our acceptance of the grant was conditioned upon
several special items being accomplished.
The City staff took exception to both the wording and content of some of
the special conditions. We felt that we could not recommend to the
Council that the City accept the conditions as worded in the CSA grant
award. Following several days of negotiations with the Community Services
Administration the staff has negotiated changes to the special conditions
as follows:
1. The Community Services Administration Regional Office has agreed
to forward the City of Lubbock's request for a waiver in the
Affirmative Action Plan, as required, to the CSA Headquarters
with the Regional Office's recommendation that the waiver be
granted. Should CSA Headquarters in Washington fail to grant
this waiver, the City would then negotiate another time span in
which to comply with these requirements and continue our negotia-
tions for an alternate method of satisfying the equal opportunity
requirements of the grant.
2. City of Lubbock will revise its Community Services Department
operational procedures to include personnel policies in
accordance with CSA guidelines, so long as these policies do not
conflict with our overall City Employee policies, or create the
possibility of violation of Civil Rights requirements.
3. No later than January 1, 1981 the City of Lubbock must complete
the election process to fill the board positions currently
improperly occupied by the Reverend Mr. Otis Cooks, Jr. and Ms.
Lillie Aguilar. The election of a new Community Action Board
chairperson also must be conducted during this time period.

4. Not later than February 1, 1981 the City must be prepared
to offer evidence that the people from the target area,
as well as the Planning Committee of the Community Action
Board, are involved in the planning process as set out
in 45CFR, part 1060.1. Minutes of relevant meetings with
attendance rosters attached will be considered appropriate
evidence. The evidence will be reviewed by the CSA Regional
Office personnel on a monitoring visit at that time.
Although the possibility exists that funding for the Community Services
Department could be terminated by the Community Services Administration
if we fail to reach agreement on the Affirmative Action Plan, I feel the
probability of that is not great, considering their willingness to recommend
the waiver that the City requested. The staff would recommend that the City
Council approve the acceptance of this grant and authorize the Mayor to sign
the grant when the special conditions as outlined above are received and
attached as a part of the grant.

No funds from this grant shall be used to pay the salary or expenses of
any employee, agent, delegate agency employee or agent, to engage in any
activity designed to influence legislation or appropriations pending
before the U.S. Congress. Thus, grantee shall not initiate contacts with
Congress that are 'des.igned to advocate, on behalf of or against, specific
pending legislation. Grantee is not prohibited from providing Congress
with technical advice or assistance upon request even if the advice or
assistance would otherwise constitute lobbying, however, the grantee must
be able to document that such assistance was provided upon request. Grantee
is not prohibited from engaging in objective analysis, study, or research
of a particular issue that may be the subject*of legislation before Congress
and making the results of such study available to the public, segments of
the public, or members, officials, or employees of governmental bodies,
including the U.S. Congress. Such study may advocate a particular view-
point of position so long as there is sufficient full and fair exposition
of pertinent facts to enable the public or an individual to form an indepen-
dent opinion or conclusion. The study must deal with the issue in question
and not with specific legislation that may be pending before Congress.
Finally, the study cannot be used as a lobbying document. As an example,
an objective study that cohcl.udes in favor of a particular position could
become a lobbying document if it is purposely released to all Congress-
persons on the evening before Congress votes on legislation relating to
the issue in the study. These prohibitions apply only to lobbying the
U.S. Congress. With regard to state or local legislative bodies, the
grantee is bound by CSR's general lobbying rules found at 45 C.F.R.
Section 1069.6. Funds expended by the grantee in violation of this
special condition will be disallowed.

FISCAL LIMITATIONS ON CSA FUNDING
It is possible that the legislation approved by Congress for CSA programs
for this fiscal year may result in legislative or fiscal limitations not
presently anticipated. Accordingly, CSA reserves the right to revise this
grant action in any manner which CSA may deem appropriate in order to take
account of legislative and other limitations affecting CSA programs and
funding. CSA may reduce the amount of this grant as a whole or as to any
program account or accounts, may limit the rate of the grantee's authority
to commit and spend funds, and may restrict the grantee's use of both its
uncommitted and unspent funds.
In accepting this grant, the grantee acknowledges CSA's authority to make
such revisions in the grant program or budget.
In no event, however, shall any revision made by CSA authorized by this
condition affect expenditures and legally binding commitments made by the
grantee before it received notice of such revision, provided that such
amounts have been expended or committed in good faith and are otherwise
allowable and that such expenditures and commitments are consistent with
the cash withdrawal guidelines in CSA Instruction 6714-1 or superseding CSA
directives. For this purpose, funds shall not be recognized as so
committed solely because the grantee has committed them by contract or
otherwise to a delegate agency.
The grantee is responsible for informing delegate agencies of this special
condition before concluding any program agreements with delegate agencies.

AGREEMENT
1. Acceptance of the City of Lubbock's proposal to utilize the Human Relations
Officer as the CAA's Equal Opportunity Officer. A written working agree-
ment between the Human Relations Offices and the Community Services Commission
or a dictum from the City Manager's Office, authorizing the HRO to:
attempt the informal resolution of any complaint of discrimination
regarding institutional services provided by Community Services funded
activities as spelled out in 45 CFR Part 1010.20-2.
2. Acceptance of the Community Service's Administration proposal to appoint a
three member sub -committee, under the City's Community Services Commission
(CAP Board) with the following functions:
Review the determination of the HRO (CAA/E00) regarding complaint(s) of
discrimination in the administration of CSA funded programs and activities.
Oversee the enforcement of the Community Services Department (A.K.A. CAA)
consistent with 45 CFR Part 1010.20-2.
3. Acceptance of the City of Lubbock's proposal to utilize its present structure
in employment discrimination (CRA Title VII) cases.
