HomeMy WebLinkAboutResolution - 601 - Agreement - Phil Price Advertising - Citibus Transit System Advertising Campaign - 09/11/1980RESOLUTION X6601 - 9/11/80 RESOLUTION C00 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock a Citibus Ad- vertising Agreement between the City of Lubbock and Phil Price Advertising, attached herewith which shall be spread upon the minutes of the Council and as spread upon the minutes of this Council shall constitute and be a part of this Resolution as if fully copied herein in detail. City Attorney N9R� CITIBUS ADVERTISING AGREEMENT RESOLUTION 4601 - 9/11/80 THE STATE OF TEXAS X KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LUBBOCK X THIS AGREEMENT entered into between the CITY OF LUBBOCK hereinafter called CITY and PHIL PRICE ADVERTISING hereinafter called AGENCY, Witnesseth: WHEREAS, the City of Lubbock has determined that it would be in the best interest of the citizens of Lubbock to inform them of the new buses to be added to the mass transit system within the City of Lubbock and to encourage the citizens to avail themselves of the services of the transit system. I. NOW THEREFORE, the CITY does hereby engage the services of the AGENCY to design and implement an advertising campaign covering the Citibus transit system within the City of Lubbock upon the following terms and conditions The AGENCY shall commence its advertising services on October 1, 1980, with such campaigns continuing throughout the year until approxi- mately September 30, 1981. III. The compensation to be paid by the CITY to the AGENCY shall not exceed the sum of $36,000. Payment shall be made by the CITY to the AGENCY upon statements submitted to the CITY monthly by the AGENCY listing in detail the expenditures on such campaign for the preceeding month. IV. The services to be rendered by the AGENCY shall be subject to approval -by -the .Lubbock Public Transit Advisory Board. V. The AGENCY shat] be considered an independent contractor and shall be responsible for any contracts it enters into for advertising services or equipment. The AGENCY shall hold the CITY harmless from the acts of its principals, employees, or agents. VI. This AGREEMENT may be terminated by the CITY upon notice to the AGENCY that the terms of this agreement have not been met and that the AGENCY has failed to perform as agreed.
