Resolution No. 2005-RO386 August 25, 2005 item 21 RESOLUTION BE IT RESOLVER BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock, Amendment No. 2 to the Agreement for Engineering Services between the City of Lubbock and Parkhill, Smith & Cooper, Inc. for the paving improvements and widening of 98`x' Street between Slide Road and Frankford Avenue. Said Amendment is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. THIS IS AN AMENDMENT TO THE AGREEMENT dated May 22, 2003 and entered into by and between CITY OF LUBBOCK, TEXAS hereinafter called "Owner" and PARKHILL, SMITH & COOPER, INC. hereinafter called the "Engineer", of 4222 85`h Street, Lubbock, Texas a corporation duly chartered under the laws of the State of Texas. Amendment No. 1 was approved by City Council action on August 16, 2004, Resolution No. 2004-R0397. The purpose of this amendment is to establish the Basic Services and Compensation for professional services associated with the design of the widening of 98"' Street. Basic Services and Compensation for Basic Services engineering and design are described in Attachment A and Attachment B. FOR ENGINEERING SERVICES Owner: City of Lubbock, Texas Project: Engineering Services for 98`s Street Roadway Design and Bid: widen 98"i Street to T-2 arterial from Slide Road to Frankford Avenue and strip -pave two-lane section from Frankford Avenue to approximately Iola Avenue. A DESCRIPTION OF SCOPE OF SERVICES The scope of services for this project is as follows under this Amendment No. 2. Work will not proceed until Owner has authorized Engineer in writing to proceed, except for those portions required of Owner by residential interests to be executed beforehand. I. BASIC SERVICES A. DESIGN SERVICES Design services as defined by the tasks and man-hours in Exhibit A-1, more generally described here as: a. Expansion of project to include design for 98`h Street segment west of Frankford Avenue to Juneau Avenue. (Note: Tasking and man-hours for designing strip pavement west of Frankford Avenue to Iola Avenue was deleted during negotiations on the original scope of services tasking and man-hours. Iola Avenue description remained in general project description due to drainage facilities that are a part of the original agreement. With this amendment that surface pavement work is re- incorporated at City request and extended to Juneau Avenue.) b. Expansion of backfill remediation scope of project to include segment west of Frankford Avenue to Juneau Avenue. C. Roadway drainage analyses associated with additional roadway design to Juneau Avenue. d. Geotechnical investigation at residences that grant entry permission to the Owner. e. Geotechnical investigation for signals foundations. f. Analyses for maximized backfill remediation where vacant property exists along the 98th Street south right-of-way. g. Analyses for reduced backfill remediation where structures exist along the 98th Street south right-of-way. h. Meetings with Owner. i. Surveying associated with new construction affecting the project and extension of roadway design to Juneau Avenue. j. Geotechnical analyses for remediation of backfill. k. Additional coordination with utility companies. Development of additional plans and specifications for extended roadway design, signalization, and sanitary sewer backfill remediation. The detailed scope of services as defined by tasks and man-hours in Exhibit A-1 are predicated on the concept of maximizing the remediation of the 1998 sanitary sewer backfill where vacant property is alongside the south fight -of -way, and reduced remediation where structures exist alongside the south right-of-way. The detailed scope of services in Exhibit A-1 may be altered or revised upon mutual consent of the Engineer and the Owner's City Engineer provided that work revisions remain within the not -to -exceed limit of this Amendment No. 2, and do not involve revisions to Engineer's work already completed. B. BID SERVICES 1. Bid services remain in the original project scope of services. C. SUPPLEMENTAL SERVICES 1. No supplemental services are included as part of this Amendment No. 2. D. SCHEDULE Schedule for services is enclosed as Exhibit B. Schedule is highly dependent on permissions for entry and activity on residential property. Schedule will be extended for delays in homeowner entry permissions, securing easements, or securing right-of-way. E. ADDITIONAL SERVICES 1. At the request of the OWNER, the ENGINEER will provide Additional Services as included herein or upon agreement between OWNER and ENGINEER defining the extent of such Additional Services and the amount and manner in which ENGINEER will be compensated for such Additional Services. 2. Any work requested by the OWNER that is not included in one of the items listed in any other place will be classified as additional services. 3. Additional services may be authorized by a notice -to -proceed in writing from the City Engineer and addressed to the Engineer. ATTACHMENT B TO AMENDMENT NO.2 TO AGREEMENT CITY OF LUBBOCK, TEXAS AND PARKHILL, SMITH &COOPER, INC. FOR ENGINEERING SERVICES Owner: City of Lubbock, Texas Project: Engineering Services for 98th Street Roadway Design and Bid: widen 98's Street to T-2 arterial from Slide Road to Frankford Avenue and strip -pave two-lane section from Frankford Avenue to approximately Iola Avenue. COMPENSATION Design and Bidding Phase Services For these services covered by this Agreement, the Owner agrees to pay the Engineer as follows: A. GENERAL The Engineer will be paid on an hourly rate basis shown in Table B-1 and subcontract personnel services will be billed at cost. Engineer and subcontractor reimbursable expenses will be billed at cost plus 15 percent surcharge. Reimbursable expenses are shown in Table B-1. Hourly rates supersede those in original agreement. The Engineer agrees to use its best efforts to perform services as defined herein within the billing limits stated below. It is understood and agreed that the maximum billings of each of the items listed below are based on the start of Services being authorized not later than September 1, 2045. If start of Basic Engineering Services is not authorized by date given, it is understood and agreed that the upper billing limit will be adjusted accordingly by a supplement to this Agreement. 4. Monthly payments shall be made to the Engineer by the Owner based on Engineer's statement. The statement shall be itemized to indicate the amount of work performed and the associated reimbursable expenses and subcontract costs. The uncontested amount of each statement shall be due and payable upon receipt by the Owner. Carrying charges of 1-112 percent per month from the billing date shall be due for accounts that are not paid within 60 days after the billing date. 6. The Engineer shall keep records on the basis of generally accepted accounting practices of costs and expenses and which records shall be available for inspection by Owner during normal business hours. B. BASIC ENGINEERING SERVICES The maximum billed for Basic Engineering Services including personnel services and reimbursable expenses for the Engineer and Subcontractors is shown as follows: Parkhill, Smith & Cooper, Inc. The Engineer shall start the performance of the authorized Additional Services within ten (10) days of receipt of notice to proceed and will complete the Additional Services within the time period determined by mutual consent before the Additional Services are authorized by the Owner.
