No. 5.7 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council of the City of Lubbock hereby authorizes and directs the Mayor of the City of Lubbock to execute an Amendment No. 1 to a Contract by and between the City of Lubbock and TIBH Industries/Marian Moss Enterprises of Lubbock, Texas, executed July 26, 2007, to add litter control and disposal at additional baseball, softball and soccer fields, which Amendment any associated documents, are attached hereto and made a part of this Resolution for all intents and purposes. TOM MARTIN, MAYOR ATTEST: Rebe , a Garza, City Secretary APPROVED AS TO CONT�'VT: Scott Snider Assistant City Manager/Community Services APPROVED AS TO FORM: Vandiver; -Attorneyo t DDreslMarianMossEnterprises07ConAmend I Res May 15, 2008 Resolution No. 2008-RO182 CONTRACT #7886 AMENDMENT NO. 1 LITTER CONTROL AND DISPOSAL FOR BASEBALL AND SOFTBALL FIELDS WHEREAS, the City of Lubbock, hereinafter called City of Lubbock, TIBH Industries, Inc. hereinafter called the TIBH, and Marian Moss Enterprises hereinafter called the Provider as heretofore on July 26, 2007, entered into an Agreement for litter control and disposal for baseball and softball fields; and WHEREAS, the parties to said contract desire to increase pricing by 5% to cover the new minimum wage rate, add Berl Huffman Softball Complex, Berl Huffman Soccer Complex, MLK Little League Complex fields and City Parks and Properties; NOW THEREFORE: WITNESSETH The Supplemental Agreement known as "Attachment B" and "Attachment C" as stated in Article 10 of the Agreement executed July 26, 2007, by the City of Lubbock and TIBH Industries and Marian Moss Enterprises of which is attached hereto and incorporated herein as if fully set forth. City Responsibilities. City agrees to pay said amounts stated in "Attachment B" and "Attachment C", to the Provider for the cost of performing described service for City of Lubbock; This Amendment No. 1 is executed by a duly authorized officer on behalf of TIBH Industries and Marian Moss Enterprises and the City of Lubbock, this 22nd day of May , 2008.
