HomeMy WebLinkAboutResolution - 2009-R0201 - Authorize Application For FTZ-260 To Operate Under Alternative Site Framework - 05/28/2009Resolution No. 2009 RO201 May 28, 2009 Item No. 5.7 RESOLUTION WHEREAS, pursuant to the Foreign Trade Zone Act of 1934, as amended, 15 CFR Section 400 and Texas Civil Statutes Article 1446.22, the City of Lubbock, as a port of entry was appointed Grantee and established Foreign Trade Zone 260 (FTZ-260) in 2003 to promote international trade and to encourage new businesses to relocate operations in Lubbock; and WHEREAS, pursuant to Section 681.167, Texas Business and Commerce Code (effective April 1, 2009) the City of Lubbock ("City") hereby reaffirms its statutory authority to operate FTZ-260; and WHEREAS, operating FTZ-260 within the Alternative Site Framework would increase efficiency and allow flexibility in working with new businesses desiring to relocate operations to Lubbock; and WHEREAS, the City Council of the City of Lubbock finds that it is in the best interest of the City as grantee for FTZ-260 to seek application from the Foreign Trade Zone Board of the United States Department of Commerce to obtain the designation and authority for FTZ-260 to operate within the Alternative Site Framework, pursuant to Title 19, United States Code; NOW THEREFORE, BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: 1. THAT the representations, recitations, and findings set forth in the foregoing recitals are material to this resolution and are hereby incorporated as though they were fully set forth in this Paragraph One; and 2. THAT the Mayor is hereby authorized and directed to execute for and on behalf of the City the Application of FTZ-260 for authorization to operate under the Alternative Site Framework as set forth by the Foreign Trade Zone Board of the United States Department of Commerce, pursuant to Title 19, United States Code; and 3. THAT the Mayor is hereby authorized to execute on behalf of the City any letters of support or explanation required by the Foreign Trade Zone Board in connection with this application. by the City Council this 28th day of May , 2009.
