Said Amendment is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. November 7, 2011 Resolution No. 2011—R0542 PUBLIC TRANSPORTATION PROJECT GRANT AGREEMENT AMENDMENT TRANSIT PROVIDER: Lubbock, City of FTA GRANT #: TX -18-X033 CFDA #: 20.509 TXDOT PROJECT #: ICB 1101 (05) 33 PROJECT GRANT AGREEMENT #: 51105F7050 MASTER GRANT AGREEMENT #: 512XXF7081 FEDERAL TRANSIT ADMINISTRATION NOT RESEARCH AND DEVELOPMENT STATE OF TEXAS § COUNTY OF TRAVIS § PUBLIC TRANSPORTATION PROJECT GRANT AGREEMENT AMENDMENT # 1 THIS AMENDMENT is made by and between the State of Texas, acting through the Texas Department of Transportation, called the "State", and Lubbock, City of, called the "Transit Provider". WITNESSETH WHEREAS, the State and the Transit Provider executed a project grant agreement on September 30, 2010; and, WHEREAS, it has become necessary to amend that project grant agreement; NOW THEREFORE, the State and the Transit Provider do agree as follows: AGREEMENT 1. Description of Amended Items This amendment extends the end date shown in ARTICLEI. GRANT TIME PER10D of the grant agreement to August 31, 2012 All other provisions of the original project grant agreement not amended are unchanged and remain in full force and effect. This amendment becomes effective on the later date of full execution by both parties 2. Incorporation of Master Grant Agreement (MGA) Provisions This amendment incorporates all of the governing provisions of the MGA in effect on the date of final execution of this amendment, unless an exception has been made by the terms of this PGA. CONSENT AGENDA ITEM #/SUBJECT: # Consider a resolution authorizing the Mayor to execute an amendment to ICB 1101 (05) 33, a Texas Department of Transportation Section 5311 f grant for renovation/expansion of the Downtown Transfer Plaza. (Citibus) BACKGROUND DISCUSSION: The TxDOT Section 5311 (f) rural public transportation grant in the amount of $673,430 was approved by the City Council at the September 27, 2010 meeting. The grant funds are for Phase I and Phase 2 of the Downtown Transfer Plaza renovation/expansion project. The Downtown Transfer Plaza needs to be expanded to allow for adequate space to conduct Greyhound services. Citibus is the local agent for Greyhound. The City of Lubbock has been awarded this grant due to the Downtown Transfer Plaza being a multi- modal facility that services public transportation buses and over the road coaches that serves the citizens in outlying/rural communities. The contract is effective when fully executed by both parties, and shall remain in effect until December 31, 2411. The grant was received/approved late causing a delay in the start of the project. The architect has reported that they will not be able to have the project completed by December 31, 2011. In addition, the Citibus' IT staff member that was going to complete most of the IT work for the project has left Citibus to pursue other opportunities. Therefore, it will be necessary to bid out the work that the staff member was going to be responsible for. Preparing and awarding the bid will take more time than had been scheduled for in the project. Therefore, TxDOT has extended the Section 5311 (f) grant until August 31, 2012. FISCAL IMPACT: Acceptance of this grant amendment will result in no additional cost to the City of Lubbock. SUMMARY/R.ECOMMENDATION: Citibus recommends the approval of the Texas Department of Transportation Section 5311 (0 grant amendment.
