HomeMy WebLinkAboutResolution - 2011-R0270 - Interlocal Agreement - Lubbock County - 2009 Metropolitan Medical Response Grant - 06/23/2011Resolution No. 2011-RO270 June 23, 2011 Item No. 5.13 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock, an Interlocal Agreement to provide funding to pay for consulting services to develop a county -wide continuity of operations plan to enhance the County's capability to perform government services during an emergency through the 2009 Metropolitan Medical Response System Grant in the amount of $127,422.00, by and between the City of Lubbock and Lubbock County, Texas, and related documents. Said Interlocal Agreement is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Passed by the City Council on June 23, 2011 TOM MARTIN, MAYOR ATTEST: RebecA Garza, City Secretary APPROVED AS TO CONTENT: Mike Kem , Fire(thief APPROVED AS TO FORM: Chad Weaver, Assistant City Attorney vw:ccdocs/RES.Interlocal Agreement -Lubbock County May 18, 2011 Resolution No. 2011-RO270 STATE OF TEXAS § COUNTY OF LUBBOCK § INTERLOCAL AGREEMENT BETWEEN THE CITY OF LUBBOCK AND LUBBOCK COUNTY WHEREAS, the Commissioners Court of Lubbock County, Texas, hereinafter referred to as "THE COUNTY", has determined that a need exists for consulting services to develop a county -wide continuity of operations plan to enhance the County's capability to perform government services during an emergency; and WHEREAS, the City of Lubbock hereinafter referred to as "THE CITY", is the administrator of the 2009 Metropolitan Medical Response System Grant; and WHEREAS, the State Administrative Agency has approved the expenditure of $127,922.00 in said grant funds for consulting services for Lubbock County for the development of a county -wide continuity of operations plan; and WHEREAS, THE CITY, as the grant administrator, desires to enter into an interlocal agreement to pay no more than $127,922.00 in grant funds to pay for the above -referenced consulting services; and WHEREAS, this agreement is made pursuant to Chapter 791 of the Texas Government Code; THIS AGREEMENT is made and entered into by and between THE COUNTY and THE CITY in consideration of the mutual benefits to each party: PURPOSE: THE COUNTY shall use the grant funds provided to it by THE CITY strictly for consulting services to develop a county -wide continuity of operations plan to enhance the County's capability to perform government services during an emergency_ THE COUNTY must complete the planning by February 15, 2012, and shall contract with a qualified consultant to provide the consulting services. PAYMENT: THE COUNTY shall provide to THE CITY a fully executed copy of the contract between THE COUNTY and the consultant, and a copy of the invoice or statement from the consultant. Not later than the 30'h day after THE CITY receives the consultant's invoice from THE COUNTY in regard to the above -referenced services, THE CITY shall pay the invoice directly to the consultant with a copy to THE COUNTY. Each party paying for the performance of a governmental function or service must make those payments from current revenues available to the paying party. In no instance shall THE CITY pay more than $127,922.00 under this agreement. AUTHORIZATION: The Commissioners Court of THE COUNTY has authorized the County Judge to execute all documents in its behalf.
