HomeMy WebLinkAboutResolution - 2011-R0199 - Study Schedule Of Stormwater Drainage Charges - 04/28/2011Resolution No.2011-R0199 April 28,2011 Item No.6.4 RESOLUTION A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LUBBOCK,TEXAS. REQUESTING THAT THE CITY MANAGER AND THE CITY OF LUBBOCK MODEL CODES AND CONSTRUCTION ADVISORY BOARD STUDY THE SCHEDULE OF STORMWATER DRAINAGE CHARGES PRESENTLY IN EFFECT,THE SCHEDULE'S EQUITABLE APPLICATION AMONG PROPERTIES IN THE CITY, AND REPORT BACK FINDINGS TO THE CITY COUNCIL. WHEREAS,the City Council of the City of Lubbock is authorized under Chapter 552 of the Texas Local Government Code to establish drainage charges for all benefitted properties located in the City; and WHEREAS,pursuant to said authority,the City Council has adopted a schedule of drainage charges most recently by way of Resolution No.2010-R0448;and WHEREAS,there has been concern expressed to members of the City Council of the City of Lubbock that the adopted schedule of drainage charges imposes grossly disparate treatment among property owners located in the City of Lubbock in that charges are based on the number of meters serving the property,irrespective of the nature of the property;and WHEREAS,a drainage charge basis that more accurately reflects a property's actual contributory share of the total stormwater runoff into the municipal stormwater system would result in more equitable cost-sharing among City stakeholders;NOW,THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City Council of the City of Lubbock shall and does, by and upon passage hereof,formally direct the City Manager and the City of Lubbock Model Codes and Construction Advisory Board to study the adopted schedule of drainage charges,comparing and contrasting it with all other options available to the City of Lubbock,and report back to the City Council on the following question: Whether any of the alternatives examined would produce a more equitable fee structure in terms of the charge being proportionate to the volume of stormwater resulting from the property,and into the stormwater system,than the schedule of drainage charges presently in effect.
