I. AGENCIES: The Receiving Agency: Lubbock Police Department The Performing Agency: Lubbock Regional Mental Health Mental Retardation Center IL STATEMENT OF SERVICES TO BE PERFORMED: Services to be provided by the Performing Agency are: 1) determining whether detainees referred by the Lubbock Police Department have a mental illness and/or mental retardation diagnosis and 2) determining whether the individual meets commitment criteria under State Law. (See Exhibit A.) III. OBLIGATIONS OF THE PERFORMING AGENCY (a) The services to be provided by the Performing Agency will be provided in accordance with the Protocol as set forth in Exhibit A. IV. OBLIGATIONS OF THE RECEIVING AGENCY (a) Receiving Agency shall adhere to the Protocol as set forth in Exhibit A. V. TERM OF AGREEMENT: This Agreement is effective March 1, 2011 and shall terminate October 31, 2011. This agreement shall remain in effect for one (1) year from the Effective Date (the "Primary Term") and shall automatically renew for successive twelve (12) periods (the "Secondary Term") unless either party hereto shall provide written notice of its desire to terminate this Agreement to the non -terminating party on or before sixty (60) days prior to the expiration of the Primary Term or such annual period of the Secondary Terrn, whichever is applicable. V'% A4 K Section 1 — Provision of Care, Treatment, Lubbock KCkat3at NlChLil and Services i3,:utal t: Magistrate's Warrant for the City of Lubbock R.t�6�rrir�.rr� url�i Primary Effective Date: May 1, 2009 Reviewed/Revision Date: March 1, 2011 Board Policy The Center provides care, treatment, and services in a safe, therapeutic, and ethical manner. Administrative Policy The provider of crisis services must be available 24 hours a day, 365 days a year, to perform immediate screenings and assessments of consumers in crisis. *Magistrate's Warrants for the City of Lubbock, TX: 1. Families, friends or other concerned parties may seek a magistrate's warrant for involuntary commitment [Texas Mental Health Code, Subchapter B, Sec. 573.011(a) (1-7)] through the Triage/Assessment Unit of Lubbock Regional MHMR Center (LRMHMRC). 2. If the person who is subject of the warrant resides within the city limits of Lubbock, TX, the following steps shall be followed: a) Upon completion of the warrant (appropriate signatures, notary seal, etc.), the crisis team will contact the, mental health representative for Lubbock County, Judge Tom Head, 775-1086. b) The judge's mental health representative will confirm that the judge is available to sign the warrant. c) A crisis unit staff person or other designated staff person will transport the warrant to the Lubbock County Courthouse for signature. d) After the signature is obtained, the staff person will transport the warrant back to LRMHMRC. e) A second copy of the warrant is made and posted in the Triage/Assessment area for future reference if needed. f) Upon arrival back to LRMHMR — SRC, the crisis staff will contact the Lubbock Police Department (LPD) dispatcher notifying the Police Department there is a warrant that is ready to serve (note: magistrate's warrants will be classified as "Priority 3" calls by LPD). g) The crisis team will notify the receptionist area of the expected arrival time of an LPD officer who will serve the warrant. h) An LPD officer will be dispatched to LRMHMRC SRC. i) LPD Priority 3 calls are normally dispatched within a thirty (30) minute time frame. If the person is violent or uncooperative, the LPD should be advised of this and a higher Priority may be assigned this call by LPD dispatch. j) If there are delays to the estimated time of arrival, the LPD dispatcher will notify the crisis team staff. k) Upon the officer's arrival to SRC, officers may park in the designated law enforcement parking located just east of the front portico. 1) The LPD officers will report to the receptionist area where they will inform the receptionist they are here to meet with the crisis team staff regarding a magistrate's warrant, m) The crisis team member and responding LPD officers will meet in a private area to discuss the case and share all known and pertinent details. n) Crisis staff will accompany the LPD officer to serve the warrant. o) LRMHMRC staff will use their own transportation, following the LPD officer to the location of the person to be served. p) Upon arrival to the person's location, the LRMHMRC staff will conduct a crisis assessment using the crisis elements of the Adult Texas Recommended Assessment Guidelines (Adult-TRAG) or Q:IGITYATTIAMY1Magistrates Warrant Exhibit A 2011 doc EXHIBIT "A" the Child and Adolescent Texas Recommended Assessment Guidelines (CA-TRAG) or other DSHS-approved screening tool. q) This assessment will determine whether the individual will require further psychiatric evaluation by a physician. r) If no further evaluation is needed, the person is informed of the decision. s) For other options available to the consumer, refer to policy and procedure for service package 0. t) The LPD officer and crisis worker will return to other duties as assigned. u) If further evaluation is needed, the crisis team member will contact the SRC on-call physician for further instruction. Persons Transported to SRC for Further Evaluation 3. If, based on the phone conversation with crisis staff, the physician determines a need for further evaluation regarding possible hospitalization, the crisis response team will arrange for the most appropriate means of transport to SRC. If LPD transports, the need for restraints shall be determined by the LPD officer according to LPD's current policies and procedures. 4. The on-call physician will meet the LPD officer, the crisis worker and the person to be assessed at SRC. 5. The LPD officer will leave the person with the SRC staff when it can be done safely. 6. The physician will perform his/her assessment. 7. If the physician deems the person does not meet criteria for hospitalization, the person is released and crisis team member will make transportation arrangements to return the person to the point of apprehension. a. If the person is found to meet criteria for hospitalization, prior established procedures are followed to ensure transition into the in-patient unit. 9. If a more detailed medical clearance is requested by the physician on-call after the person has arrived at SRC, the crisis worker will contact Lubbock Aid ambulance to transport the individual to UMC ER. 10. The crisis worker will alert the UMC ER of estimated arrival time and of the services being requested. 11, Medical clearance is done in accordance with previously agreed upon protocols between SRCH and UMC ER. Persons In Need of Medical Clearance at University Medical Center 12. Refer back to Step 2.(s). If, based on the phone conversation with crisis staff, the physician determines that the person in need of further evaluation regarding hospitalization appears to have physical needs requiring emergency medical care, crisis response team will arrange for the most appropriate means of transport to SRC. Normally this will be by EMS. 13. The crisis worker will alert the UMC FR of estimated arrival time and of the services being requested. 14. Medical clearance is done in accordance with previously agreed upon protocols between SRCH and UMC ER. 15. The crisis team staff will notify Joanne Harwood, crisis line supervisor, and Leonard Valderaz, Hospital Administrator, by e-mail of all individuals sent to UMC ER for medical clearance. *For policies and procedures pertaining to Lubbock, Crosby, Lynn, Hockley and Cochran counties, refer to Procedure entitled "Obtaining Magistrate's Warrants for Lubbock Regional MHMR Center Rural Areas.
